A great vacation in a great community...

    Hello Everyone;

   Florida Power and Light -- We know of two sections of the Bay that have been experiencing outages--Some for short times some for hours.  We know these occur in the Floral and Indian sections.

   If any of you live in other locations in the Bay and are having trouble  with your electricity please call Arden at 202-4584 and she can add your location to the list. FP&L are working on the problem but it may take awhile.

   Thank you Arden for connecting residents with the Power company. When we stand united it means more and also helps FP&L get a better overview of where more trouble spots may be.  

I'd like to take this opportunity to thank EVERYONE who came out to vote. While other areas had single  percentages of residents voting we had a great turnout.  

   Sue and Mary were in Viera for the absentee committe and got the first offical numbers that night, as given out by Lori Scott's great team.  They thought the presentation and professionalism of the committee reviewing the absentee ballots was extraordinary.  An overhead so everyone could see and they encouraged us to ask questions.  Friendly, and welcoming...just like government should be!  

Great job Lori and her incredible team. Special thanks to Eddie for all his help over the past weeks.

ELECTION RESULTS - Great turnout!!

3223 PEOPLE VOTED OR 37.4%

Crouse    26.62% or 858 votes
Guinther  30.96% or 858 votes
Raponi    18.49% or 596 votes
Weglein   23.92% or 771 votes

Great turnout of voters.
All the other precincts had about 4 - 9 % so Viera was impressed with our turnout.

1.  Carol got up early and took a card table over to position it.  She put Wilma and Sonny's name on it....went home to gather up things, and when she returned, Louise and Tom had moved it, stating "They didn't know whose it was.  There was no name on it."  





11/7 - Tomorrow is voting day!!!   Vote for Truth!!!

We want to thank all of you that got involved and helped make this a very successful campaign, no matter what the outcome!  WE ALL MADE A DIFFERENCE!  We made some wonderful friends and in spite of the intense work and pressure that we were under - We had a great time working together!!!

We can say that we did all that we could do educate the residents on what has been going on in Barefoot Bay.  The vote is the conclusion for the Trustee positions, but our cause and research will continue, no matter who wins!  In fact we will ramp it up a bit after a break.

Don't forget to Honk for Hal when you see Susie White driving around the trailer with the sign VOTE FOR TRUTH!!!

Sunday, November 6, 2011  Happy Daylight savings time....

 

We have an update for you about the situation with many of our residents loosing power...we know this has been going on for a long time now, especially with the Floral and Indian sections of the Bay.

    We understand that FLORIDA POWER and LIGHT has placed a ground “outage” meter to get some data. This meter will remain in the ground for 21 days and then be given to a specialist who will see the data. That will take about 5 days more. Perhaps by December the “on and off” situation will be corrected.  “Fingers crossed”.

Several of you have asked about the price for the renovation of the Laundromat.  We believe it is around $58,000.00, which is higher than budgeted, and they say it is because they have to bring it up to code, put in A/C, etc.  Of course all that would have been expected with the first bid also.....Makes you wonder...

Friday, November 4, 2011  Good Morning. Carol here.

 Yesterday I attended the Special meeting of the Board of Trustees  (building E) which was to consider the award and the protest for the RFP  (Request for proposal) concerning the work that needs to be done to make the shopping center/ laundromat building ready for occupancy by our new WELLNESS CENTER.

The meeting was about 45 minutes in length and all trustees were in attendance as well as the Board’s attorney  and District Manager.

 The protest from Mr. Templeton was one of the topics and the procedure was in questions.  He did not receive the changes that other contractor bidders received.  They did not appear on line (as is customary). This late information was given after a second contractor asked questions of the engineer. Once a question is asked the answers are public and are to be sent to all bidders so they are bidding on the same specifications.  This response was done just a few days before the end of the process and Mr. Templeton did not know of the alteration, therefore his bid was higher than it would have been had he been notified of the changes. When he did receive this information, he rebid there was about $250.00 difference between himself and the other low bidder.  .

Mr. Templeton said several times he was apologetic to be making this protest but he felt that procedures were not followed and that was his main issue.  Guinther asked Mr. Templeton if he would withdraw his protest, now that it was heard, and Mr. Templeton was gracious enough to do this so that the project could go forward and not be held up by the rebidding process. The contract was awarded to Jag enterprises.

 A resident whose name I do not know, was the only other person to speak. He stated that all these delays had gone on long enough and since Mr. Templeton had withdrawn his procedural protest that the vote should be taken to award the contract and his words “Let’s get our gym open”.  We will all be glad to see the gym/Wellness Center here!


Now, a few personal observations from me--.

It has been five months since the Wellness Center came before the Board and presented the proposal to rent space in the shopping center. It will probably take another 6 to 8 weeks to renovate the space for them and have them move in.... I am amazed at Mr. Lail's patience with this Board.  These delays must be creating difficulties and expense….equipment to be stored, employees hired to work with us have been “on hold”... as well as a myriad of other business oriented issues... THANK YOU JASON for being steadfast. The residents appreciate all your patience and we are eager to see you settle in ASAP>>>>

 I am very concerned with a statement Guinther made near the end of this meeting.  He said that they have felt PUSHED to get these projects (Wellness Center space and the lounge)  done.... that implies to me that someone is rushing now......and that is absurd.... The lounge project started about a YEAR ago (after 10 to 12 years of waiting) it is certain that no one was rushing then.  It was stalled for months this summer.

We could be DONE by now with both of these projects. The shopping center has been sitting empty for way too long.....with nothing done...these projects needed attention a long time ago...why were they not addressed then?

To imply they are rushing now to satisfy the residents is such a Tall Tale.  WE residents have been wanting these promised projects done, but we are also tired of all the consistent and poor procedures that create the problems. 

I am pleased (as many of you are) that these projects are at last moving forward. WE do have policies in place to deal with these procedures but it seems that these policies are NOT being followed.  I will ask Sue to post them for us, so that we may see for ourselves the written policies that are already in existence so we can see what is being followed.  You can decide for yourself.

The policy manual is being updated because Klosky made it a priority.  I attend the meetings as can anyone.  These are important as they are supposed to be what the Finance Manager and other managers use as the guide for ‘How Barefoot Bay is To Be Managed and Run.”  Updating policies is good, but only if you are doing what is already established, as what makes anyone think new ones would be followed any more than the old?   

The meetings are on the calendar in the office.

Sue here - I did not go to the meeting and am responding to what Carol wrote.  First of all, Guinther has no problem getting his pet projects done.  Well, come to think of it Higgs and Chevallier couldn't manage to get his mini bandstand done when they were running the joint either.

Funny he should mention the policies and use it as an excuse. Guinther and his crew don't follow the policies we have now, especially Chevallier.  Why would we think it would be any different with new policies?

On October 21 I sent this email to Jason Y District Manager regarding the lounge RFP which was also screwed up.  I hope they aren't thinking that they will have a good reason to bring Higgs back--saying that things haven't improved!! Because the same ridiculous procedures are being followed as when she was here.  NO ONE PAYS ATTENTION TO THE POLICIES - THEY DO WHAT THEY WANT.  Here is our policy.  Notice the huge role a department head plays in this, making them accountable for what they know best, even if someone has to interact with the architect, builders, etc.  In this case neither of the department heads even signed off on these.  I was told they gave "verbal approval".  Wow, that's accountability.  

Request for Proposals or Request for Qualifications (RFP's, RFQ‟s) are written documents issued by the Department Heads and approved by the Community Manager, inviting potential vendors to submit sealed proposals for specific professional services or goods in conformance with the scope of services, terms, conditions and other requirements described the RFP documents. RFP's are utilized for procurements of professional services or goods with an aggregate cost of $30,000 or more.  At the time of publication of the RFP/RFQ a copy shall be furnished to each member of the Board of Trustees.

Here is Jason's reply, which seems like he has graduated from the Higgs/Cheavllier/Guinther school of MIS-management.

"Once the elected body approves the funding, staff moves forward with the RFPs for projects. Kathy Mendes and John Morris reviewed the RFP documents and gave verbal approval. After staff approvals, Jason Pierman gave authorization for the RFP to be advertised per district policy. It was advertised in Florida Today on September 29, 2011. The RFP document will not tell you who signed off, because that is not a district policy requirement."   Jason Y.

According to our policies manual as stated above,  the RFP is written by the Department head....is Terry the head of the Lounge?  That would seem that Kathy Mendes/JOHN MORRIS would be writing/SIGNING OFF ON this RFP.  

Terry still controls RFP's, nothing has changed except the story they tell.

We have had illegal bid procedures, two poor RFP's, tearing down smoking signs, abuse of employees, no monthly reconciliation of bank accounts, hidden bank accounts, arrogant behavior, retribution tactics, poor cash management (as per auditor) and much more.    NOT ENOUGH TO FIRE TERRY but any other employee would be out in a second.  

So I asked Jason Y for the first RFP.  Terry and Jason both stated that there was no first one.  Now that's honesty for you!!

The Guinther and his three Board clones were just making fun of Klosky's committee rewriting the policies manual a few months back....just before the auditor came.  Then they stopped laughing.  

What does Barefoot Bay need and deserve?

Open and transparent government as we are promised and as Trustees pledge.  This one makes it difficult to get the answer to anything.

Honesty through and because of the open government, which are our rights by law.  If government does not enforce the laws, it leaves it up to us to hold our elected officials accountable.  

A Finance Manager and Board that is accountable for every penny spent through sound financial procedures and policies.

A team of employees that are cross trained so that anyone can do the other's job, insuring smooth management. 

R- E -S-P-E-C-T
That is what the Bay will see!  One way or the other.

11/3 8 am - Last night we stopped by to see Mim Holmes, who remains deeply distressed by the lies/letters/calls from management/Trustees over the Memorial Service incident.  She refuses to engage with any of them, realizing that their defense is all they are interested in, not her pain.  She is taking the high road, and moving on, trusting that the truth will some day catch up with all of them and deliver what is just and fair.    

Mim is going to get back to the adjustment of life without Hal, which is where she needs and deserves to be.  And, we are honored to know her, will be there to support her, and proud of the woman she is.  





11/2 - 3:14PM Just in from a former Barefoot Bay resident--

"I once was a resident of Barefoot Bay, but moved because of all the crap that has been going on.  I did not want my monies controlled by this Terry person.  I do not trust her or anyone that would stand up for her.  Get rid of all of them, then maybe myself and other 
concerned people of the Bay would have respect for the trustees again."






11/1 - 11PM - 
Rumor has it that Terry called the Vero Beach Press and told the editor that all this bruhaha over the Memorial Service was a political ploy to get the incumbents out of office.   

What a horror story.  We hope Mim will put this to rest and get on with her adjustment to life without Hal.  The rest will play itself out as it is meant to be.   





 


11/1 7:20PM - Good research on me, but I am not running for Trustee or applying for a job, and I think I already said I am controversial and strong-minded.  But, I will start a Sue Stories page for those that want to hear the response to things that have nothing to do with THE PEOPLE THAT ARE GETTING PAID TO WORK FOR US OR WHO HAVE PLEDGED TO BE A TRUST-TEE.  

As for target, if anyone should be defensive it should be me.  I am personally attacked for letting the residents know what is going on and stating opinions of lots of people and and the "facts."  

-The managers wrote a letter about Terry, not me.
-Terry and Nancy had a gag order on employees, not me.
-Tom kicked Terry out of a Board meeting and got her so mad she told us she had three things on him and he wouldn't fire her.
-Employees can't stand working with Terry, so much so they cancelled the Christmas party - not me!
-Residents were so fed up with Terry SDS made a bunch of promises - not me!

We are the ones that are willing to take this on and it is the support of residents that keeps us going.  

Let's see the list now.  Mim Homes, Carol Joseph, Sue Woodward, Wilma Weglein, none of us can be trusted, but Tom Guinther and the three other Board crew, and JR, and Terry can???

That's some list.  Let's remember that we got encouraged to get involved by Tom Guinther......that is who encouraged us at the start.  So your theories about "takeover" are about as valid as "Terrorist Group" etc.   We could return the favor, as we already have plenty to talk state about JR, but we aren't going there.  

We keep going no matter who wins, doing what we are doing.  We will still be blogging and keeping check on what's going on.  

Carol Joseph is back from a week's vacation and she will start blogging again too!

Thanks to all of you that are finally seeing the reality and speaking up.  As you can see, there is a strong level of attack on anyone, including Mim, if you speak about this Board, Terry or Higgs.  Big retribution--just like the employees told us they experienced.










11/1 - Good Morning.  A beautiful one after all the rain.  

Just to update readers - Please note that Bob Kahl, head of HOA, complained two weeks ago and several times after, about the posts I wrote when three individuals called in from the HOA Candidates Forum. 

They had very strong feelings and opinions and I wrote as they spoke to me.  

Bob did not like their opinions.  He said they were not true, and asked us to take them down.  We would not.  We did post a note that stating these are opinions and have no basis regarding the intention of the HOA. 

People are entitled to their opinions in this country, as you can see from what people say on the Tattler blog and paper.  We don't ask the Tattler to take down what JR and others blog about us, just because they aren't true.  

The Tattler is always in a defensive mode, trying to attack the messengers who do the research and the work.  The Tattler never talked to us, never asked us why we are doing what we do, nothing.  

The Tattler (JR) has not spent hours and months searching out the truth, five feet of documents.  Instead JR spend hours trying to attack people and sell what they want people to believe - Tom's story.  Tom's Tattler.  

We are in an advocacy position, trying to uncover and bring to light the many things that didn't make sense--things the trustees, residents and employees brought to our eyes. Things they asked us to look into and get involved in.

I believed SDS President Pete Pimental when he said they were going to have equal managers.

I believed him and gave him a chance when he said Terry would be limited to finance and stay in her office.

I believed SDS Jason Pierman when he told us the same.

But when Terry started dictating to Jason Pierman, SDS lost credibility.  

When Jason P. told us they "changed their mind" and decided to let her handle Customer Service and more, after promising over 100 residents at a Board meeting that they would do what they said, we realized they were just selling the same story--the Tom story.  We believe SDS might be good at what they do, but in this case, they are not able to do their job.  Terry dictates what she wants.

When Jason Y., new District Manager let's Terry get away with all the recent screw-ups, and Pete Pimental tells us there was not enough documentation in her file to fire her.  

Pete, we can have all the complaints rewritten that are missing from Terry's file, as well as have twenty new ones!  

Still no one fires her in an at will employment state.  Because they can't.  They are under orders from Guinther, who seems to be moving into the same control mode as Terry.  Now he blogs on the Tattler.  He runs Strategic planning with all the Board, and still RFP's get screwed up.  Why?  Because they are in a defensive mode.  Innocent people don't have to defend.  

We do not have time to defend a position as we are uncovering the reality of why Barefoot Bay is being run the way it is.    We are advocating for residents and employees that were afraid--for good reason.  

Bob Kahl came to my house several times a month when all this started.  He asked me to run for a seat on the HOA Board because he liked the fact that I spoke up and was strong.  He wanted someone strong like that to work with him.  I told him he doesn't really know me.  I won't stop because he tells me to--not if there are reasons to keep going.   

He verbalized his support for what we were doing-- if something wrong was going on, he wanted to know about it.   I believed him.  Since we "found" the missing account, which Bob asked me about, he has never once taken interest in seeing, hearing, evaluating...nothing. That is a fact.  Not an opinion.

Bob admits he loves the job Nancy Higgs did--which we find difficult to understand as Nancy is the person that allowed Terry to do all she did, and more.  But, that is his opinion and he is entitled to it.

We can thank Nancy for the trouble the Bay is in today. 

We can only surmise (opinion) that Nancy called him and said, "Now, Bob, you know me better than that.  Do you think I would ever do something like that?"  And he believed her. 

Of course people wish we didn't stir the pot.  It isn't fun.  It isn't fun for us.  But sometimes if you don't stir, things burn.  Somethings have been very wrong for way too long, and it is time to right it--and we will continue to do just that.    






7PM - Here goes Tom again, a tear jerk apology on his new blog.  

The contract with SDS says the District Manager reports to the Board and SDS. Tom can tell Jason to fire Terry, but of course, he won't.  Why not?  We never a straight answer.  

As for his version story, it sure doesn't match Mim's. 

I wonder who has the most solid reputation at this point?  Someone who protects Terry and has a lot to lose, like Tom.  Or Mim.  Pretty easy to figure out the answer to that question.

Terry runs the department, she runs everything so don't try to wiggle your way out of this one.   

Residents TAKE THE BAY BACK
11:00 AM - Getting lots of phone calls and updates today.  Seems that Tom Guinther called Mim and said he apologized to her, which she very firmly told him he did not such thing.  Also, she told him that she thought it would be a good idea for Tom and Terry to move out of the Bay!  Yeah Mim!

People have tolerated way too much for way too long. 




10/31 -9:00 AM   
Also, we hear there were five Board Members at Strategic Planning, plus the two candidates for Trustee, Jason Y, Sue Cuddie (on overtime) and about five other people.....Sounds like a Board meeting on planning....lots of talk, no action.

Lots of late hours going on at Bldg F.  Friday night Terry was there until 10PM, Saturday til 5ish, and Sunday until 9pm.  Her boyfriend joined at 6pm.  What's going on that is so pressing and urgent???  Probably a last effort ditch to do something right before the election.  There is money in the building during the weekend too.

I hear that Terry's department screwed once again, by not having this scheduled for set up either.





After what happened last night at the Memorial Service for Hal Holmes, it becomes a clear reality to many residents who had doubts, that Terry can do whatever she wants, and RIGHT IN FRONT TOM GUINTHER!!!  

We all like Tom when he is doing his job, but he is now protecting his conflicts of interest.  He cannot do the job of Trust-ee as long as Terry has this job.  WE NEED TWO NEW TRUSTEES TO GET TERRY OUT.  

This incident last night may also prove that SDS dances to Guinther, not to what is in the contract.  But who knows, maybe SDS and the Board had an agreement that "binds" them to one another, such as Terry and Tom have.  


Latest news in from the Bay, is that Terry Chevallier did not have Bldg D&E scheduled, which means as usual, she distorts the truth.  
THURSDAY - I have been called by four people today and asked to write about the Memorial Service for Hal Holmes.  Mim's asked to have this posted on our website.  As you read on, you will see that there is much more than just the memorial that moved people to ask me write this. Something happened today which seems to have stimulated an outreach of pure disgust for what is going on in the Bay....  

The service was wonderful.  It was from 1-4 at D&E and there were 125 - 150 people who came to honor Hal.  Susie White did the eulogy, as Hal was one of her best friends.  Hal was in the Navy when he was 17 years old and on a destroyer that was hit by the Japanese.  He was in the water, trying to survive when he came upon a younger man who couldn't swim.  Hal took off his life jacket and gave it to the kid.  That's the kind of guy Hal was.  The VFW and American Legion were there and did a 20 gun salute.  His daughter and grandaughter were also there.   

Hal and Mims were together 51 years and lived in Barefoot Bay for about 25 years.  After the eulogy everyone sat down and shared a meal.  Everything was perfect until....

3pm when Terry Chevallier, Tom Guinther and Jason Yarborough walked in.  They went and sat at table and started having a Budget meeting, with no regard for what was in process.  Mims went over to them and asked them politely to leave, stating that she had these rooms booked from 1 - 4pm.  (Please note I am writing this from what was told to me and not embellishing)  Terry replied rudely, "I don't care what you scheduled.  I'm having our meeting because I scheduled this at 3pm."  Tom Guinther sat by and did nothing. Jason said nothing.  

Mims left and was upset and crying.  She got angry and wondered how these three could possibly dare to do such a rude thing on this occasion.  Finally she went back and told them to get out.  "I want you out of here.  My husband's memorial service does not deserve to have to deal with you."

Tom got up and said, "Let' go to the 19th hole."  

Jason later called and apologized to Mims who replied, "Your apology is not accepted. You and Tom Guinther sat there and let that lady talk to me rudely.  I don't know where you came from but I have lived here 25 years and we deserve respect for my husband's memorial.  How stupid can you be to do what you did?  There is something very wrong in this Bay and you are now one of the problems."  

People are furious, as they well should be.  I believe that all this came together at this point in time for a reason, and the reason is that no one deserves to be treated this way, let alone residents!!!   

Tom Guinther should have stood up and fired Terry on the spot, by now he has about 4,198 good reasons, but he doesn't and he won't--ever .  Because Terry has too much on Guinther.  This is just what Tom said would not happen and it is still happening, right in front of him and 125 guests.  

I hope this finally lets all the residents understand what we are trying to say and do.  Tom is not the problem, he is a symptom.  TERRY IS THE PROBLEM AND UNTIL SHE IS GONE, there can be no change because she has control of the facts and the truth.  Sad but true.  

SDS was called.  Mims will be calling Melba to tell her she wants this story published in the Tattler.  We will be distributing this story in the Bay to let people know the depth of the disregard and ill behaviors that have taken over--along with the lies.  Because now people are convinced that there is something so very wrong that it will not change until the locked vote on the Board is changed.  We need two new Trustees to do that.  We need two new Trustees and a new attorney to get to the truth and get back the respect and pride that we all had for Barefoot Bay. 

We are honored to be asked to write about this, and we are saddened at the state of affairs. 

A resident sent in this,  "What idiots would walk in on a full room of people eating at a memorial service and sit down at a table and start holding a budget meeting.  I don't think a budget meeting was ever scheduled but it doesn't take a smart person to know they were intruding.  Have they lost what little class they may have if they ever had any?  So glad this was seen by all."



As for JR, he obviously has some major problem with Woodward, as I didn't even write what he is complaining about.  It was Joseph.  It seems someone ripped the antenna off Raponi's car tonight, and only two people left.....JR and a resident....hmmmmm  

Barefoot Bay trustees hope probe puts mismanagement rumors to rest

Hope is the right word.  They hope this probe will put this to rest, but it will not.  GLAD YOU WENT AHEAD WITH THIS.  Thank you Florida Today, Nancy Higgs, and Cliff Repperger/Gray Robinson!  Just as we predicted.  This demonstrates why Florida is so corrupt.  And to think it comes out the same day as the last candidate forum...what a coincidence.

DID I NEGLECT TO MENTION THAT GRAY ROBINSON IS ONE OF THE ATTONEY'S FOR Florida Today!!!!!  

We are writing this in red, white and blue to show our pride in the laws of our country.  Freedom of Speech.   

Here's what we have to remember--In Florida graft, sexual extortion, political abuse, cocaine habits, poor management of retiree's money. threats...no one cares.  It's too common and has become part of the way you do business. As the Florida Grand Jury of 2010 said, it is socially and culturally acceptable.  

WELL IT DOES NOT HAVE TO BE ACCEPTABLE FOR RESIDENTS OF BAREFOOT BAY because it is against the law.

Did this paper contact us?  NO.  Did  Susanne Cervenka call us before publishing.  NO.  In fact, Susanne never told Wilma Weglein she was talking to her about this article at all, but rather let Weglien assume was about a candidate story.  

 As quoted from the article, "Wayne Holmes, chief of staff for the State Attorneys office, reviewed the document. He said he found "a lot of speculation, innuendo and politics," but nothing that rose to the level to prompt action by his office.  

It reminds me of the social and cultural mindset that law enforcement used to have for rape victims.  "What did you do to ask for it?"  "What were you wearing?"  "Were you drinking?" That was the cultural and social enforcement attitude, where now it has become more sensitive to what the law really is.

You see it is against the law to threaten the life of someone, which the Finance Manager's brother did after a Board meeting.  It was reported to Guinther, Pete Pimental and Jason Pierman of SDS.  Jason assured us he was going to discuss it with the Sheriff's office.  Did he?  If so, for some reason that doesn't count either.

Or how about extortion/black-mail which was directly said to me...a signed witness statement?  Nothing there for the police to investigate.

The Sunshine Laws are also to be enforced by these agencies and 2009 there was supposed to be training for law enforcement, but the cultural attitudes prevails.  Why? Because people don't demand change.  

Change requires law enforcement to be sensitive to the residents that are trying to speak up for the law, just as with rape victims.  It is obvious that we are culturally stuck when the Sheriff's office takes on an investigation only when the Board of Trustees Attorney Repperger wants it, but not when over 65 residents asked.  It is not fair.  It is not just.  It is not right.  But, it is the reality that we must fight against.

None of us want to think that people we considered friends do what we believe was done. The facts all lead us to this place and we are zeroing in on the endpoint, without the help of enforcement.  

Why would they leave a Finance Manager in her position who is still screwing up weekly. Why is she still there?  Well, graft, extortion, political abuse all go hand in hand with poor management  --  it takes the focus off the facts.

BUT When BBRD attorney Cliff Repperger/Gray Robinson goes to the Sheriff's office so Florida Today can write this article, the same day as the last candidate forum, and just before an election--well, not there's enough evidence to investigate.  Florida taxpayers are now paying for an investigation when it suits the cultural climate.  That is not the intent of the law or government--to work against the taxpayers.        

As for transparency, did I mention that attorney Repergger refused to explain to us why the Auditor said that we were short money this year and Cliff would have to do a legal maneuver to make it work?  It was confidential--so much for transparency.

I emailed Gannett a couple of months ago, (they own Florida Today) complaining about the lack of coverage this paper does.  I gave this reporter, Susanne Cervenka, an exclusive on the day Dave Kershaw decided not to take the job as District Manager for the Bay--just two days before the Board meeting.  He knew all about the controversies, he knew about the website, he had signed the contract.  WHAT DID HE FIND OUT AT THE LAST MINUTE THAT MADE HIM NOT TAKE THE JOB?  Honest newspapers would want to know, especially since Kershaw is from Melbourne.  But not Florida Today.  They seem to publish the stories their cronies want them to.  

Susanne is also the same reporter that called me a few months ago, wanting to know what was going on, but only the day before a Board meeting--she said she wasn't doing a story. We caught on and canceled the meeting. 

 It is Attorney Repperger who asked for this investigation because the Board told him to do whatever he had to, no matter how much it cost to get this website down.  That's a threat on freedom of speech!  No on cares?

We are digging as hard and as fast as we can.  We are spending our time and money to root out the truth in a climate that makes it difficult, to say the least, with absolutely no help from any enforcement agencies.  It remains to be seen how this investigation will pan out.  

People thank us daily for taking this on.  They asked us to.  They were afraid to speak up and still are.  I can see why.  We were afraid when the Board threatened us.  I was well trained at Newsweek Magazine and Joseph has a high level of integrity.  We feel an obligation to fight for the rights we have, or we might lose them.  That is the state Florida is in. 

As for Jason Yarborough's quote, he is the one that just told me his contract was confidential!!!  So much for transparency.  

What we have gone through is anything but fair and just.  It is hard work.

What has changed is that this Board is tolerating more because Higgs is gone and Chevallier has to behave until after the election. 

It is up to the voter's to decide who they want to run this Bay. It is up to us, residents and citizens of the United States, to demand our rights be upheld.  We will continue to do that through the legal channels no matter what this election brings.  

That is our right.  I think a judge would find it very interesting that the Sheriff doesn't respond to our pleas but does to an attorney.  Keep the faith.  Barefoot Bay residents have power in their vote.  Power to put us on a better track...an honest one...a financially accountable track.

And, just maybe, one of the newspapers will tell you the whole story, not just part of the story.

At last night’s board of trustees meeting an Investigator Harry Bermudez spoke and requests that should any of us see anything suspicious to please report it to Bob Kahl who heads up citizen patrols.

I am deeply concerned about the leadership of the Bay and I know many of you feel the same.                                   

The 19th hole renovation (and last minute addition of the sports bar) was completed in about six weeks but the renovation of the Laundromat space continues to sit idle.  This space has been leased to our badly needed and eagerly awaited WELLNESS CENTER. Yet the work has not even begun!! WHY NOT?????     This is such a travesty....honestly...what IS going on with the people who are "in charge". And who IS taking responsibility for this?  It was originally set to hopefully open in late October... Now if we are able to BEGIN the renovation it MAY be ready for the New Year.

These people have been pushed aside for months...WHY?  The contractors spoke at the meeting and were disturbed that their questions have not been responded to.  (Join the club)  We need this facility, it is eagerly awaited. Our residents still have to drive for physical therapy, gym, and to other wellness sites because we have NO RESPONSIBLE leadership...... do we care?  YES!!!         

Who is the PERSON responsible for all these unnecessary delays? Remember this wellness center has been coming to us since the SPRING....as you can see for yourself on the BOT meeting cd 's avl at the office for 50 cents each.   The constant delay of this project and the delay of the long awaited LOUNGE renovation is just an example of the same problems we have been dealing with for two years.  Now they are in the open.

Micro management from the Board of Trustees is partly to blame.  Their job is to oversee MANAGEMENT.  We pay $130,000.00 for SDS management.  Every employee has a specific  job to do but they still are NOT ALLOWED to DO their job. The finance manager is still sending out RFP'S when our policy manual says the managers research and create the RFP’s.  These latest delays (wellness center and lounge) are suffering the same fate.... The Truth Will Set Us Free....
10/26 - 
Seems that last night at the Board meeting the Board was on good behavior and another RFP was done incorrectly.  Our policy manual says the managers write up their RFP's not Terry.  Now why wouldn't they do what Pete Pimental told us he would?  

Here are the facts, and the fact is that in Florida law enforcement does nothing about public abuse or the Sunshine Laws.  That's why Florida is the fastest rising in the state.  

Let's see - we have extortion charges, death threat, sexual harassment charges, internet threats, a bank account listed in a city we never heard of but the Guinther and HIggs signed off on it, no reconciled bank accounts for 2 years, gag order on employees, almost all red the flags of corruption and bank of america agreeing with our accounts as of September 26, 2011.  

There are a lot of possibilities to investigate if someone wants to get to the bottom of it.  On the other hand, if someone wants to stop us from getting to the bottom they will claim there is not proof.

Some of the Board is trying to tell us all is well with our finances.  

Management/SDS/Jason do not seem to be changing anything with purchase orders and RFP's still going out from Terry when the managers are supposed to be issuing them as per our policy manual now.

In 2-1/2 years this Board allowed Chevallier/Higgs not to balance the bank accounts

Nor did they bother to balance the ledger--therefore at the end of the year we make adjustments to the books to make it balance.  WHERE IS THE MONEY?

We spend $140,000 on finance and still get those results

Terry is obviously allowed to do things her way, not in the best interest of the Bay

Trustees should have access to bank accounts, they do not--even though we were told they did

We had three findings that carried over for at least three years

We can't even see the contract between SDS and Jason Yarborough. 



Oct 25 - Good Morning Barefoot Bay - We have heard a RUMOR that there is information floating around about our candidates which is being spread to insure that at the very least Guinther gets a seat.  The reason is that this Board cannot afford to lose their three vote majority which has been going on for a long while -- since they voted on having the County collect our money and they threatened a trustee with "you are either with us or against us."

You see, that is illegal.  That means they are talking to each other and know what the other ones are voting.  They aren't even supposed to be at the same meetings and discuss things that they are going to vote on--that happened at least twice in the past year!!  And, Guinther was the one doing it.  He has to stay in control to keep Terry so she doesn't unleash what she already admitted to way too may people--not just me.

As for why JR is their personal voice box?  I can only presume that he must have a lot in common with them--and he is protecting them and himself, why else would he putting this paper in the position he is.  

We are not a paper.  We are a website that came into existence the day Tom Guinther, (who talked to us 2-3 times a week and encouraged us to get involved), changed his mind and sat me down at the pool (lots of witnesses mind you) and told me they wanted me to run for Board of Trustees, but I had to stop looking into the past finances.  WHO IS THEY TOM?  WHY WOULD ANY HONEST TRUSTEE MIND IF WE LOOKED ANYWHERE?  THE LAWS SAYS WE SHOULD AND CAN AND ARE OBLIGATED TO LOOK TO INSURE JUST GOVERNMENT.

So, Tom's strange request (after all the other strange things we saw and heard) got us to see that residents deserved to know what was going on without all the time and energy and resistance that we had to churn through.  After all, concerned resident are what got us started in all this.  SO WE STARTED A WEBSITE TO INFORM RESIDENTS OF THE TRUTH.  WITH FACTS.  Facts that we are going to continue to address through the legal system as this place is so corrupt that paid enforcement is the only alternative so far--well, at least until we launch our national press campaign.  

I mean really, we send the sheriff a list of concerns and we get no response?  Cliff Repperger walks into some office he gets an investigation? Or at least he can say he has one until after the election where they may claim (based on his letter) that there is not enough evidence for them to investigate.  Obviously they can say what they want, it's a free country.  BUT IT IS AGAINST THE LAW TO HIDE THINGS, LIE, DECIDE THINGS AHEAD OF TIME WHEN YOU PLEDGE TO BE A TRUSTEE.

SO tonight at the Board meeting pay a lot of attention and ask WHY DOES THE BOARD HAVE TO AMEND THE BUDGET NOW?  BECAUSE WHAT THEY DID BEFORE WAS NOT OKAY FOR THE NEXT AUDIT AND THEY ARE FINALLY STARTING TO TRY AND DO THINGS PROPERLY, which means every penny needs to be applied to a department, project, expense, accounting code.  

BAREFOOT BAY RESIDENTS, for over 28 years my Mom and Dad thought they could be here and not get involved.  Just come for the winter, enjoy their stay and trust the Trustees because they could trust Avatar.  Not the same now.  This is a government.  WHAT WE WANT, THE ONLY THING WE WANT, IS WHAT WE ARE PROMISED BY THE STATE OF FLORIDA.

Open and just government.
Employees treated with respect and by the law
All residents treated with respect whether you like them or not
Transparency
Honesty
Accountability for finances

Managers who run the Bay need to do so based on the policies, not their own personal agendas.

WE WANT WHAT THE LAW SAYS WE ARE ENTITLED TO IN SPITE OF THE LAWS NOT BEING ENFORCED!!!  WE ARE THE PEOPLE.  WE ARE THE POWER.  NOT THE TRUSTEES.  NOT TOM GUINTHER.  AND NOT A FIXED BOARD.

Oh, and all that crap Guinther fed us about not being responsible for "Terry", that it was up to SDS--well the contract says the District Manager is responsible to the Board and SDS - another distorted truth to cover his butt so he didn't have to get rid of the finance manager - who has a rather torrid past by the way.  

Golfers, we want to promise you, everyone of you, and the staff that we will fight for you as we are for the Bay.  We aren't going to working for the Trustees or running meetings, we are going to be working to insure that we find a way to come up with ideas and plans to move all the interests that are here into a better position as a team.  The Board oversees all of us, not a special few.  

And, I believe that the illegal Guinther signs were taken down.  Thanks Sue if it was you.  She came to the Fund Raiser picnic so we got a chance to meet and she said she was going to call and if they were illegal she would take them down.  Yeah!  Honesty!

Just read the latest blog.  So happy the event went well!!
A shame what some people will stoop to keep their train on the track.
I hope someone with a strong IT background will extract the "address" of the blogger who sent out the threatening E-mail.
Would be very interesting to find out how close to home this "phantom" is.
 
It is very important for everybody to exercise their right to vote on this very important issue..

When people have to attack you personally, they are hiding something.  We are attacking what they do in the name of Trustee, the laws of Florida, the laws of this country. 

Why ARE people are giving money this year???  Because this is the first year residents have been honestly informed as to what is going on.  It is the first year residents are standing up for their rights instead of being intimidated by Higgs and Chevallier.  Every resident deserves to be treated with respect.  Every employee too.  IN THIS COUNTRY WE HAVE AN OBLIGATION THAT COMES WITH FREEDOM AND RIGHTS.  THAT OBLIGATION IS ACCOUNTABILITY.  ACCOUNTABILITY IS NOT EASY IN FLORIDA, BUT WE WILL HELP RESIDENTS MAKE SURE THAT THIS GOVERNMENT IS ACCOUNTABLE FOR WHAT THEY HAVE DONE AND WHAT THEY WILL DO.  

Unlike four trustees, Terry, Nancy, JR, we have no hidden agendas.  We are trying to right what is wrong with the freedom given to us, and we are lucky we have those rights.  Why should we stand by and watch people take them away from us.  Rights and freedom come with responsiblities

Monday 10/24 - Yesterday I met Sue, who puts up Guinther's signs.  We had several email exchanges and she came to the fund raiser and we met.  We had discussed the placement of the signs on Micco Rd, which are illegal, as they are on County property.  I was not pleased that a Trust-tee would allow this but Sue said she would check with enforcement on Monday to see if they are legal.  She said she could put signs where we do. 

She can but that doesn't make it legal.  As usual, we do the work and talk to the businesses and get their approval and support.  They tell us where to put the signs.  We talked to people who owned lots or the relatives of the people that owned lots for permission.  JUST ANOTHER SIGN OF THE "UNDER THE TABLE" WAY THIS board does business.  

How can Tom Guinther run an ad in the Tattler without any money in his account?  Not legal. 

Last week we also asked for Jason Yarborough's contract which we were told is confidential.  SO MUCH FOR TRANSPARENCY.  We have retained an attorney and now realize in Florida you have to let the attorneys ask the questions as Transparency enforcement as it pertains to corruption only happens through the court legal system.  WHAT COULD BE IN JASON'S CONTRACT THAT THEY DON'T WANT US TO SEE???  Maybe he answers to Terry after the election, or to Nancy and Terry?  Maybe that is why Dave Kershaw decided to can the job two days before meeting us???  

The Board spent a great amount of time discussing the lights in the parking lot that Terry and Nancy wrote the purchase order for--without any sign-off from maintenance, as usual.   
We demanded to see the original purchase order at the first policies meeting.  Two managers and Klosky told Higgs at that meeting that they had all told her what the current voltage was and yet we sent out the wrong specs. 

 This Board doesn't blame Terry and Nancy for not including the managers involved,  but blames the contractor!!!  We really can't believe a word the four say as they are unwilling to admit to any truth about Terry, Nancy, lights, RFP's, purchase requests, etc. and all that has been going on around here.

HERE ARE THE LIGHT SPECS THAT THEY SAID DIDN'T EXIST WHICH I BELIEVE BOB KAHL SAID THEY DID.  HERE THEY ARE.  SO MUCH FOR TRUTH AND TRANSPARENCY.  NANCY HIGGS WRITING.  That is the day before Nancy quit.  She does not like to be accountable to residents or anyone else it seems.  SO MUCH FOR HER HONESTY.  

I am amazed that the Board has so much trouble finding things that we can find so easily.  Makes you wonder once again about transparency.  Below are the sheets torn out of the book, Nancy's handwriting.....more smoke and mirrors by the 4/5 of the Board.  What a waste of time and money.

 
8:57 PM - What a great Picnic Fund Raiser we had.  We had free drawings for over 16 gifts from businesses.  I would guess we had about 100 people.  The music was great...Thanks to the Freddy Cook Band.  They do such a range of music.  Everyone was upbeat and happy.

We have created an incredible campaign team, with all of us adding our expertise to the task at hand, dedicated and passionate about the need to get honest blood back in the word Trustee.  We have fun and have designed a great campaign of reaching out to the residents and informing them of the TRUTH.  

Thanks for the many supporters who contributed today and offered to help in the final days of the campaign.  It is easy to see that people are ready for a change that will bring our community to a place we can all work together.  You can't blame them when you listen to these four at a Board meeting.  It's obvious they are covering up for Terry and the past.

All good things have to end, as I came home and read the Dribbler, which is my new name for tattler.  Melba has my sympathies.  This guy borders on insanity.  Why go after me?  I am not running?  They tried to turn us in for the picnic and now he attacks me?  They just keep making our job so much easier.  We have a threat which will get us National Press, we have some newspaper tantalized by the corruption, and we are going to keep right on going no matter who wins.

Okay,  I don't why he feels the need to find fault with me.  Maybe he is jealous.  He should be.  I have a great life, great friends, am intelligent (he said so a month ago, remember) and I loved all the jobs I worked at.  Northeast Jet Company too.  We took calls all through the night and had to ask a pilot to do something, not always knowing whether it was legal or not.  It was their perogative to take the job or not.  If not, we would not make them but we did have to call the owner who was a heavy drinker, maybe drugs too, and could get very demanding of them and threaten their job (sounds like Terry and Nancy).  

So I quit after three years and started my own businesses.

A couple of years later a Federal Agent called me and told me the pilots were all saying that I treated them fairly and protected them  and wanted me to testify as I was "management."  I did as long as they afforded me personal protection, which they did.  That's all.  I was a witness for Congressional investigation into a private jet company and the FAA.

I think it is wonderful that people have faith and a desire to get in new Trustees.  These two have let the people down, diverted money, lie, and allow Terry to keep doing the same crap she always has.  Why?  Because Terry knows about the sexual harrassment, sunshine laws and money.  Just like she said.  

So, Barefoot Bay is ready for a change and people are motivated.  We are so motivated the candidates don't even have to pay us back.  What do you think about that?  

We have so much faith in getting a positive change in, that we support our candidates.  What they have to give us back is fair and open government to all residents.  They don't have to buy us anything, give us any money, print a paper that supports us, or share any money with us -- unlike some people.

Now, back to things that make sense.  We were in the office last week and asked for the original purchase order for the lounge, which we know went out at the end of September.
Terry lied about three times and told Carol there was none.  The only one was the one that went out in October but we all heard Tom say it was going out.  Well, we happened upon that original RFP (Thanks McAfee)  and as usual, the compulsive liar still lies, still does crappy RFP's without any sign off from managers.  

So bad that it got kicked back for not enough information...She is costing us money and this Board allows it.  BUT the sad part is we asked Jason Yarborough and he said the same thing so either he doesn't even get to see what she sends out or he is a liar also.  Obviously Pete Pimental is not, nor has ever been running this place.  Terry does because Guinther doesn't have the cojones to do what is right for Barefoot Bay.  

This is disgusting.  Barefoot Bay deserves bettter than these liars are giving them and Terry costs us money -- over and above the $140,000 we spend a year to cover up what they take on the side or did, since we got the account closed.  

RESIDENTS - GET TWO NEW TRUSTEES IN WHO ARE HONEST AND WE WILL BE WORKING AS A COMMUNITY INSTEAD OF THE LONE RANGER AND HIS THREE MOUTH PIECES.

This Board lied about Terry, as evidenced by this purchase order.  They seem to be controlling Jason who has to protect her instead of doing the right thing.  She costs us money because of her control issues.  No one gets along with her except Tom.  Sure we have plenty of money, that's not the point.  

Wilma Weglein brought the idea of having the taxes collected by the county ( I love to repeat that as it gets Guinther so angry for some reason, but we have it in the minutes!!!)

Before the election we will be showing  you the money games this gang of four have been playing on us.  

Have a good evening and I will try not to read the Dribbler anymore.  We are moving our story out to the borders of Florida - corruption and lack of enforcement are socially acceptable until people stand up and demand change.  We can be those people.

Today we received a threat to take down this website in one month or this person would destroy me and anyone I know via the internet.  Upon some investigation there are some likely people who have this background that are being considered.  We also have our techie's looking at this, as well as the agencies we reported this to.  

This person claims to be a friend of Nancy Higgs and Terry Chevallier it seems.  Why would they have friends like this?   Anyhow, we will not be stopping.  

I do appreciate the fact he tells us what he is doing and states that all that he does will be false, so that I can send people his email so they can understand.  He is creating email addresses for me and possibly joining me on websites, so if anything odd comes to anyone from me, you will know why!

Our response:  I looked under my bed for money and he was partially right. I found 35 cents but it wasn't in a box.  He must not know me well, as I seldom have cash.  

As for the rest, we are starting to pull our resources from Washington DC, as well as National Press to combat the apathetic enforcement and attacks. 

I am not running for office.  We have freedom and rights.  We have laws that allow us to ask questions, find documents and demand accountability.   It is our right as citizens.  

10/22/2011 - Today my column is out in the Vero Beach Press Journal "Probing Corruption" and is below.  I will also be posting the email threat I received today if I don't take this web site down in one week!  

Tom Guinther's signs are now being placed on County Property, which is illegal - so much for Trust!

And, tomorrow is the big fund raiser at the corner of Waterway and Bird for Wilma and Sonny.  There will be lots of free drawings for the great gift certificates businesses donated, as well as food and beverage!  All Free!  We just hope you'll contribute a few bucks to their campaign to help us get honesty back in the word Trustees!!! 

10/22/2011 - Here is one sentence, of the many great ones, that Cliff Repperger, the BBRD attorney, wrote about Wilma after her last term as Trustee around Nov 2008.

"You have given so much of your time and effort for citizens of Barefoot Bay and you should be very proud of all you accomplished as Chairman of the Board.   You were instrumental in helping survive the period after Grace left and your dedication to help during that period is something I will always admire."

Gee we are good at what we do.  Just in, hot off the press is a letter that Cliff Repperger wrote to Wilma after her term in office complimenting the great job she did.  We will post it soon.  
10/21 Thank you to all of you that are supporting us and the right to expect our trustees to uphold the trust they pledge.  Every day people call someone and ask for a sign or two.  Every day they thank us for letting them know what's really going on.  And, every day we hear in spite of people liking Nancy, it's her fault we are where we are.  She did not do her job but rather let Terry try to do it and they broke many of the SDS contract requirements.  We will be going after SDS regarding this.

As you know, Tom gave an angry attack at the HOA meeting about don't believe or read SayBarefootBay.  He doesn't mind if we read "his" paper though.  The odd thing is that I wonder why the trustees bother to read the truth we print, but tell everyone else not to.  

I hope we are not paying Cliff Repperger to defend the conversations he had with Wilma Weglein after the tattler (good name) tried to find fault with her dedication to financial accountability a few years ago....  

Cliff almost wrote a book saying well, yes I talked to her, and I looked at my notes, but I didn't approve it, well I didn't not approve it and on and on....

Here are the facts.  An attorney for BBRD does not work for us, the people!  We pay him over $140,000.00 a year to advise the Board, not protect us.  Cliff is proud to spread the word across Florida how much money he makes off of us, which is about equal to what an attorney gets to advise a city!!! 

So basically he protects the Board, not us.  He protected Nancy Higgs, not us or the contract we had and have with SDS.  He protects Terry Chevallier, not us.  An attorney's role is to advise the Board and this Board wants SDS, Nancy and Terry protected.  WHY WHY WHY WHY

SDS needs to be sued for not doing what they said they would do in their contract with Higgs, and they better not be doing the same with Jason.  Oh, I will have to get that contract today.  We will be going over the contract to make sure that it is the same one Higgs had or let you know what is different.  I believe Jason is getting paid less, but they never mentioned the terms.  Isn't that discrimination?  Same job as Nancy but they pay Jason less?  Why would that be?  Or do they plan to bring Higgs back in some other form...like an ambassador?  

We are starting a non-profit TAG - Tracking Accountable Government - Who's enforcing Florida Law?  You're It!  

Our first job will be SDS's contract and why this Board did not and does not enforce it.  

Back to Wilma - Wilma was on the Board for a financial mess and the District manager hired a few people from the Bay to straighten out the mess...Wilma did it for free and later on the manager gave her a check and would not take it back.  Wilma, whose advisor was Cliff, did not tell her to give it back, nor did he announce it, nor did he tell her to pay it back, nor did he mention it at a Board meeting or make notes saying it was wrong.  It's like zoning, if you accept it you are giving it your blessing -- just like accounts that we didn't know about.  Just like when Tom wanted to "get rid of SDS because they aren't doing the residents any good."  Cliff talked him out of it because it may not have been in Tom's best interest to do what is best for the Bay.  When would that be true?   When the truth would put Tom in a worse position than leaving Terry in her job--that has to be pretty bad.  

So now this Board has Cliff, or he volunteers, to review this past...is this costing us money for him to write a dissertation to help "show fault with a candidate?"  I trust that he will not charge that to us as that would not look good.  Let Gray Robinson pay for it, they owe the Bay a lot of money for the financial lack of accountability that we are in. Some advisor for the Board.  How could any attorney justify keeping Chevallier?  Oh, Cliff is good friends with Higgs, Chevallier and Higgs are "best friends" and Terry lives at Higgs house where Higgs still has one or two of our computers....How come they don't answer that question?

Where is the computer that the Bay bought Higgs?  Why don't we have it back?  Is her name off our bank accounts and our trustees on?  Why not?  That is the attorney's job.  And then there are the cameras at the Bay that Higg's and Terry can monitor--is that still going on?  Why?  Is Terry in charge of security, Pete Pimental.  Do you run the contract or does the Board?  

As for his latest tattler blog, we have Terry's resume.  We called the school. As we stated, they have no record of her.  Funny how this diploma is now appearing.  Maybe this is a diploma like you can get Bank of America to verify these are the only accounts open as of September 26.  Oh, this school is out of business but the one on her resume still exists?  Let's assume she does have a two year degree.  What a college!  They don't teach them that reconciling the bank accounts for two and a half years is a good idea?  

Or, the alternative.  Before we started collecting all this money Terry's financial reports made sense....maybe they don't want financial transparency when all the money came in...for some reason.

As for Terry, if I were the Tattler I would stop right there.  We have tried to state the facts of financials...wow, now they are proud she is reconciling the books after two and a half years....some good her supposed degree did.  

If there are any more comments to defend Terry Chevallier we will expose all the truth about her and there are quite a few facts we have held back on.  Don't go there.  We don't want to destroy Terry, we want the Board to do their job in spite of her and get someone who is financially accountable so the Board can eliminate all the smoke and mirrors most of the Board tries to use on residents.  

Thank you Board and auditor for getting Terry to balance the bank accounts for September.  You have done one part of this well.  

Why is she still managing Customer Service when her boss, Pete Pimental said she wouldn't?  Because this Board can't tell her no because she has too much on them.



It's exciting to hear all the people that want change.   It's about time.  

Information and accounts are public record.  I put it up not Wilma.   Mr Cliff Repperger thanked me for my cooperation.  The attorneys told me about the Swipe fund theory.

As for $1000 for Wilma....I hear Wilma was in there working as a part-timer for three months about six hours a day, with a new  community manager to help them get caught up on posting assessment payments that were not in at all.  yeah WILMA.  THANKS FOR REMINDING US OF HER HONESTY AND DEDICATION.  

One day the manager gave her a check for $1000.00 for 2-1/2 months of work because they were paying other people $10 an hour.  The manager refused to take it back so Wilma, being the honest person she is, asked Mr Repperger if it was okay and he approved it.   

Now let's compare that to what the incumbents do.  They say everything is fine financially because we have lost of money so they don't mind if they waste it, don't account for it, put it aside....After all, look at all that's coming in.  

This Board spent over $140,000.00 on accounting, accounting assistants, accounting consultants which works out to $560 an hour and we still don't get the bloody bank accounts balanced!!!! (FACT - LOOK AT AUDIT FINDINGS BELOW)  That is not good oversight.

Wilma's paycheck back then comes out to $3.00 an hour. Thank  you Wilma for your dedication.  Thanks for reminding the voters how she is always willing to help when it was needed.  Now we have SDS who the Board pays another $140.000.00 to who is supposed to make sure the accounting people balance the bank accounts.  That puts us up to $1020 an hour and for 1/4 of a million dollars we can't get the bank accounts balanced?  I can see why this was brought up.  To show us just how extravagant this Board is with our money but they can't seem to do the things that need to be done to safeguard it.

We know that two new Trustees will break this fixed Board vote and get SDS to do their job, and give the District manager responsibility for accounting, as well as good employee management.  Right now SDS promises us things that the Board dictates, like let Terry stay in customer service, let her keep her job.....why?  Because she knows too much.  

As for the Golf professional, the fact is that the Board voted to eliminate the pro's commission and so increased his salary by 27% instead, which meant an $800 yearly reduction based on his past commissions.  So what?  And how could the Vero Beach Press do a retraction before Wilma said it?  The Tattler is well named.   

We have some ideas that will make those golfers happy!  


After the candidates forum, a resident asked Guinther a question about $300,000.00 that was put aside for "reserve" back in 2009.  He said something to the effect that $150,000 went to something and he doesn't know what happened to the rest. 

THAT'S WHY WE WANT TWO NEW TRUSTEES.  Tom can stay and run Strategic Planning as a resident, but he certainly doesn't deserve to handle SDS, the Finance Manager, the District Manager or the Board when it comes to Accountability because he hasn't taken care of our money nor done a good job of overseeing Barefoot Bay.  

We're trying to put up on youtube the segment where Tom had some good sense and told the Finance Manager to stay out of the Board meeting if she left.  That's the Tom we could trust--not this guy.  

And, I heard he denied that he told me that, "This Board is not doing the residents any good.  We have to end this contract with SDS."   Then, there is no doubt he is lying.  I was working and talking with him 2 - 3 times a week.  He told me he didn't like to put anything in writing on email.  Now I know why.

Also, we are going after National Publicity based on just the thought that an attorney could go to the Sheriff's office or State Attorney's office and ask for an investigation to prove themselves innocent, when we went to all of the above over the past six months and got no response.  People have to take a stand and demand the change and protection we deserve.  

12:55 pm - Louise Crouse was handing these out Sunday (although we heard she does not have a campaign bank account open) with an invitation to something....claiming the following:

"...continue the financially stable and progressive direction of Barefoot Bay."

"Proven leadership and Fiscal Responsibility"

I am sorry but how can you write the email below, do nothing to change things, have five audit findings, three of which are repeats for three years, not have the bank accounts balanced in 2-1/2 years and call that fiscal responsibility.  

This has been a lazy Board that got a lot of money in a very short time.  Unfortunately they got themselves into situations that forced them into a position of allowing this lousy financial and employee management to prevail over who they are as people.  Here's what Louise wrote just three months ago and from what we see, they have done nothing to change a thing.  The Policies committee is.  This Board focuses on SMOKING issues instead of money issues (except when they say Chevallier tears down the no smoking signs that is.)

9:53 AM - I got a cordial reminder from Repperger that I had neglected to cover an account, which was unintentional.  And I corrected it and apologized for missing that one.  

On the other hand, I did make sure I took off all the numbers on the other swap receipts and I noticed that Zepherhills was approved by at least three people!!!  Something that I had missed previously.  

Tom Guinther approved the payment form Zepherhills FL, and Nancy Higgs, as well as I presume Chevallier.  

Now wouldn't you think one of those people would have noticed something wrong with a mailing address in Zepherhills FL, when it has not been there before?  We did.  Makes you wonder...

10/18 - 8:49 - Good Morning Barefoot Bay to a lovely, gentle rain.  

I received an email this morning from a resident that expressed his feelings about residents sitting back and letting all this happen...and it is true.  When you drive around and see two foot high grass -- it gets us all so angry and yet nothing changes.  I researched a little about Snug Harbor and they have a system that enforces their codes immediately.  We have discussed many options and the first step is to get that apathy out of the way.

People have to care, have to speak up, have to ask for change when things are not right--and things are not right now.  We have a Board that discusses things in advance and votes as a Block.  THE ONLY WAY FOR CHANGE IS TO BREAK THAT BLOCK.  We need to put two new trustees in who are honest.  Then we can start to recapture and protect the Bay we all love.

This Board can yell and scream and threaten and attack, but basically what we are all asking for is EXACTLY WHAT WE HAVE THE RIGHT TO EXPECT.  Any one that votes for Guinther and Crouse can expect lower property values, and more wasted money.  I wish it were not true.  I hoped that Tom would stand up for what he told us.  

In fact when he spoke with Carol this summer at the swim lessons, he told her that he would not let all the positive changes that the two of had brought to the Bay slip away.  Until Cliff talked him out of it.  He is boxed into a big corner and he is not making the best decision for the Bay--he is afraid of what might happen if he were honest about what has been going on.

We are not running for office.  We will not stop.  We are getting to the bottom of this whether it takes a week more, three weeks more or five months.   Until we get a new Board that is not "in the pocket" and "orchestrated", we will continue.  We have nothing to gain personally, but we are the same people that brought this community Summer Fun Club.  We do it because we see a need and we advocate for needs. 

It is not an easy job and the pay is not good, but because we have so many people supporting us and thanking us--well, it makes us keep moving forward,

By the way, did you know we bought Nancy Higgs a nice laptop computer or two?  At least that is what we were told by them, why do we have to buy five for the Board?  Why don't we get those back?  

Please note that all of the below comments about the HOA Candidate Forum were feelings expressed by people that were there or called in and discussed their opinions.  In no way did anyone blame the HOA directly or any person from the HOA.  This is a heated election and people have strong feelings.  That is what a democracy is about.  Creating change.  Change does not come with apathy.  Change does not come with retribution.  Change does not come with control tactics.   Change comes with freedom.  We thank the HOA for holding this event and all the time and effort they put in. 
Here's a real bank statement from Bank of America for the Swap fund...we never see these, the money that is made every night when the funds are sent out.....We are told over and over again that those once a month statements are all there is.

We are zeroing in all this and no matter what happens, we are going to keep digging until we get to the bottom of all this-- not matter how long it takes...

Oh, and remember.  Vote in two new trustees, because we are sure Mershon is just holding a seat for Tom if he loses.  Two new trustees are the only way Barefoot Bay can stop the orchestrated Board that talks and breaks the Sunshine Laws, decides on votes.  Back in 2009 we found minutes that Tom Guinther went up to Joe Klosky and said, "You are either with us or against us."  Referring to the collection of the taxes and the vote by the Board.  As Joe said then, if Tom knows how the Board is going to vote he is already breaking the Sunshine Laws.  It has only gotten worse since then.  

If he denies it, like he does everything else these days, we will be happy to post the minutes.  Barefoot Bay has a crooked path to truth and we need to change that.

   Good Morning... It has been a while since I have been blogging… lots to do during this election time so Sue is doing double duty for us.

   I attended the HOA candidate forum yesterday. There was about 70 people in all. Most who came did so to support their candidates and some came to learn more about all four.

   Lynne Kahl addressed the group to explain the 2 charter proposals that will also be on the ballot. There was discussion until it was clear to all. Good job Lynne.

   Bob Kahl introduced Nancy Eislie who was the moderator and did a nice clean presentation.

   There was nothing new. All four candidates stated their views.

   Sonny went first.  What an honor!  He will bring a fresh, honest outlook with an “open door policy” for residents and employees alike.   His background includes managing huge budgets and functions as executive chef with the Peabody Corporation, as well as teaching culinary and he is passionate about getting the Bay run properly.  He wants the District Manager/SDS to do the job right and he will advocate to see it happens. 

    Louise supports the code enforcement and deed of restrictions, safety and health issues, she continues to work on the recreation items such as resurfacing the walking paths .

   Tom talked about getting the bathrooms done in building A. Golf course improvements and the 19th hole renovations. He started a Strategic Planning committee to get projects done, otherwise projects languish for MONTHS in committee.  At the end he was angry, as usual, and said not to listen to Say Barefoot Bay. 

            Wilma spoke about her views.  She believes that the manager should manage the Bay.  That’s what we pay them for. The board of trustees should oversee, as per our charter.  The District and Department managers work together as a team to give us a well-run community.  Wilma is on the policies committee which is updating and rewriting the manual which is the guide for running the Bay... the rules and regulations have not been adhered to, as well as the financial policies need to be updated and detailed, as per the auditor.  That’s all for the forum. Carol

  I must add a personal note here....Why is Tom promising all this now.  He has been on this Board for four years!  Just before the elections?  It would have been wonderful to have done this years ago. For instance the lounge project has been on the list of renovations for over 12 years!  Buildings need maintenance and upkeep that has not been done... yet newly proposed projects, like the 19th hole, jump to the head of the Strategic Planning  list.....hummmmmm.

   There have been only 2 strategic planning meeting so far  and the first one was August 27th 2011 (the next one will be October 29th Saturday at bld D&E ) and already the 19th hole lounge/ sports bar is complete.  How is it his projects magically get done and over budget in just 6 weeks?   Priorities?

   As for Tom’s statement of not reading SayBarefootBay.com,  I will say it AGAIN. We do our best to call facts facts and rumors rumors.  We are fact finders and have six feet of paper work, bank statements, phone bills and e-mails to back up what we  say. You can see a lot of these facts up on the site and there will be more coming as there is a lot for you to know.

 You have a decision to make.  What type of management do you want for our homes and community?  And there is no reason why we can't reduce fees with all the money we bring in...if we knew where it went!

Take a drive through Snug Harbors.  Property values are up a bit over there and it is easy to see why.  They are beautifully maintained and enforced.  

Barefoot Bay Property values have dropped, lawns are 2 feet high, bank accounts have not been reconciled for three years, as per the auditor.  Yes, we have lots of money.  That’s the problem.  We have no one responsible handling it and a Board that has not done a thing in the past 2 years to correct these issues and for some reason......they will not get rid of the Finance Manager is spite of all the complaints...I wonder why that is?  Oh, we know why.  She knows too much, just as she told me.  

Change will come with honesty in Finances ,The Board and the District Manager. 

 

 

 

 

 

 

 

   


2:09 another update just came in from someone who attended the HOA candidate forum.  Slick Tom said not to listen to SayBarefootBay.com.  I am shocked.  Just a few months ago he offered me a job to start up a website like this for the Board if I would stop looking into the finances.  What changed your mind Tom?

Thank goodness we are one step ahead and posting all the things we have found so you can see why they don't want anyone to believe SayBarefootBay.

For instance, just as I was getting the update I was looking at the reports the Trustees used to get for the swap fund...As usual they give you the total picture.  I will post one of those later.  Be assured WE HAVEN'T SEEN ONE OF THOSE IN THE TWO AND A HALF YEARS of data WE HAVE RESEARCHED and asked for!!  

When we ask we only receive a year end statement of payment.  We hear it is a common practice in corrupt Florida to have that account on the side, called a Swipe account or such.....an easy way to graft a little money.  Of course we aren't accusing them of doing this, as we have never seen one statement to be able to know.  So much for transparency.  

Also, I have reviewed in more detail the "proof" they got from Bank of America.  We will be revealing just how ignorant they must think people here are.  As Nancy Higgs told me, "What do you think of a Trustee that says "Just keep the assessments down and the residents won't bother us."

First report in from a caller at the HOA Candidate Forum - Sonny got the first question and he was nervous...of course he was nervous.  This is a hot campaign and Tom Guinther has a slick delivery of whatever he wants to feed the masses.  Big deal.  We aren't looking for Slick, we aren't looking for anything but honest.  We want a Board that works together to make things better, instead of a Board that talks about things before meetings and then makes an orchestrated presentation to sell the residents.  

Sonny and Wilma are for financial accountability.  They believe our bank accounts should be balanced every month - imagine that.  They are honest and willing to bring the people an agenda to move this place forward into honest accountability, support for what we have, and much more.  

One of the attendees that called in was very upset and thought the incumbents had the audience stacked, and that the incumbents seemed to know the questions (imagine that).  We were told half wanted to see the questions ahead of time, and half didn't.  So the HOA went in favor of who...Guess, the incumbents!!!

Below are more facts we are showing about the "magic" account that now doesn't exist.  read on and vote for PROTECTING THE BAY WE LOVE!!!!

10/16 - Please note that due to your concerns and inquiries, we want to assure you that at this time the rumors about the Sheriff, Harry Bermudez or the State Attorney investigating to "prove" BBRD innocent, when they didn't bother to investigate the facts to prove them guilty, remain rumors.  

After all, we heard it from the BBRD attorney, and we all know you can't trust lawyers.

And, we heard it from a very reliable source at Florida Today, who seemed to have the facts mixed up and thought residents were asking for this.

Now why would these agencies ignore the 68 or more residents that signed our fact finding mission and pay attention now?  That just doesn't make sense and we will continue to keep the faith until we hear back from the Sheriff's office and State Attorney's office.

Now, for today's fact, which make much more sense than what BBRD says...
We are going to post the bank statement that caused all the excitement at the less than professional audit presenation.  

After digging for 7 months, we were given by the office a statement from Bank of America Merrill Lynch Swap fund payment that was very different than the previous years.  OF COURSE IT WAS A MISTAKE!  Terry didn't want us to see it, as that was most likely the three bags of shredded documents that left the building when all this broke and she had an hour meeting with Tom Guinther.  

Saw it ourselves!  

Here they are and we will explain under them.

Now the 2008 swap debit shown above has our checking account number, address, reference number, etc.  makes sense.  That's we look for, Woodward and Josephstein, things that don't make sense and we find plenty under the administration of this Board.
Now the 2010 swap payment above, does not have the account number on it, same reference number for Bank of america, and we see the debit from the checking account.  all is consistent
Suddenly what to our wondering eyes should appear but something that doesn't make sense!  

Barefoot Bay now has an account in Zephrhills FL, on the other side of the state???...and when we asked Terry about it, she had no idea.  Had never seen it before.  Could not explain it, but then she seldom can.  She was on the phone with Cliff Repperger getting an opinion after she promised to sign a statement saying that all the bank accounts we have are the ones they say, who told her not to sign it and to ask me at the Board Meeting.  

Tom Guinther quickly appeared in Building F, looking very distressed and not very friendly, he just sat within hearing distance as we repeatedly asked how money could be listed at a place Terry was not aware of?  How could they just not wonder about it?  Where did the money come from?

Okay, so being honest citizens we emailed the auditor general directly and let him know, three days before the end of the audit about an odd account.  That's when all the smoke and mirrors appeared....of course this Bank of America swap statement was from January 2011, not in the audit year he was working on.  During the audit presentation the auditor told us he approved it because he got a verification from Bank of America that we only had the accounts listed, but as you will see below, they stated that as of September 26.  Then he got a second verbal that it was a mistake!!!  You bet it was!!!   A big mistake.  

So now we pay our attorney to cover up things that he should be protecting us from?  

More to come tomorrow...Like think about this....This statement says they withdrew $172,157.80 from Barefoot Bay in Zepherhills Fl.  So Woodward and Josephstein, not being as good as Woodward and Bernstein, noticed that we also paid the same amount out of our checking account on the same day.  Now, just imagine that it was a mistake, just as Bank of America said.  You see strangely enough they never told us they paid it out of the checking account, which could eliminate the "error" but because the auditor needed to see "account receivables" to balance out the inflow of money now.....Cliff had to make a resolution --one that still isn't up on the website --- We will post that tomorrow too.  

10/14 5:50pm - Well, rumors are running wild today.  

We hear there was a "private" meeting prior to the Board meeting.  

We hear there was some use of inappropriate language by the Whining Board members that is not something Barefoot Bay residents want or need to hear.

We are not sorry we missed it as we had important things to do that are more worthwhile than listening to these pre-planned sessions.

We also hear that people are seeing the Board on TV and find it disgraceful, which it is.

Just think, it could have all been avoided if they had sat down and asked us what we thought was going on.  "We want to know and get to the bottom of it also."  That type of thing.  Of course they didn't and they don't.  

We did hear from one of the Newspapers that "citizens" (more likely  Repperger volunteers) going to the Sheriff wanting an investigation.  I wrote to the Sheriff as I am doing a column, and wanted to know how I would explain that they investigate to find someone "not guilty" when special citizens ask but find our citizen requests not suitable for investigation?   If it happens it will be great as it will get us on the national news.

Poor treatment of employees under Higgs/Chevallier was a fact.  

Lack of Financial accountability is a fact for three years --just since we got money...smokescreen...

Conflict of interests are still facts

Unaccounted for money is a fact

All the red flags of corruption, as the Treasurer said, and this Board has done nothing to change that....so what does that tell you?  

As for you golfers, we want you to know that we know membership is down and Barefoot Bay can afford to keep golf going.  We are going to protect golf and we have a great plan to generate money and drive people here. 

 So don't let Tom fool you.  Golf needs Financial Accountability, because with all the money this Board has allowed to be mismanaged, an honest Board can afford to do a lot.  And, with our new manager, it might just get the Board back to listening to ideas and plans, and letting management implement them in a constructive, team oriented way.  



10/14/2011 - Did you know Florida has the fastest rising rate of political corruption?   The latest Grand Jury from Dec 2010 studied public corruption and made it clear that " citizens are often confused as to who is responsible when it comes to holding our government officials accountable."  There are great laws that aim at giving citizens the right to oversee the trust against abuse, like full and public disclosure, but the fact is abuse of office is at an all time high.

I thought I'd update you on the latest fun facts.  We went to the Sheriff's office about our complaints for three months and they wouldn't investigate, look, discuss anything.   

Now the whining Board gets Repperger of the infamous Gray-Robinson to go to the State Attorney, who seems to have upheld the law we are happy to see.  I mean the least they can do is be fair in their lack of response.  Now if the Sheriff needs more people to look into our facts, well, he should have just told us.  We have about 300 now.  But now Repperger is spending our money by trying to get the our "not true statements" verified by public officials???  

 What we have learned about Florida is that attorneys make sure they answer the questions they want answered or not at all.  To get to the real answers you file against them.  

I only have one source, and since it is from Florida Today who has not covered one story about Barefoot Bay but loves to ask a lot of questions, we will check it out.  This is called law enforcement by popularity?

We will be asking the Sheriff is he investigates based on number of calls, facts, attorney's or what?    That is what you pay your tax dollars for!  Why have an ethics committee, when you can just ask the Sheriff to investigate and dis-prove facts that were not good enough to have the sheriff look into them.  

I bet they think that if they get an article in Florida Today it will give them some validity.  Think again.  I gave their reporter two hot news tips and guess what!!!  They did nothing--not even about their own Dave Kershaw.  I guess Higgs has them in her pocket.

10-14 Good Morning and a beautiful one it is.  Board Meeting at 2pm today, Bldg D&E.  Remember you live in a democracy in spite of this place being run by a Board that acts like it is otherwise.  Employees have rights.  Residents have rights.  And, Trustees promise to uphold those rights.  Say hi to JR who is planted in the back usually to say, "You don't believe her, do you?"  

Why such a big defensive plan if they are hiding nothing??

Lots to write about.  We got the agenda for the Board meeting Friday at 2pm at D &E.  It seems that the Board wants to discuss employees talking to residents on business hours.  Let's make it clear that when Higgs was here, the morale was so bad and the control issues so out of whack, as stated in the Managers Letter, that things were discussed and should have been.  The Board should be pleased, as it was discussion that got the wrongs corrected.  And, if the Board had done something about all the complaints from the employees they would not have felt inclined to speak up for the good of the Bay.  The Board was as unresponsive as Higgs was.

I am happy to say that since Jason Yarborough is here employees aren't talking to us on company time, maybe they are talking to the Board or others.  We might chat in friendly ways, but we haven't even been around.  Any other time is off employee time and that is not against the law.  

When things are wrong employees have the right to speak up and the obligation.  I believe this is a free country, free press, free to make opinions and to state our thoughts and beliefs.  It sounds like the chain of command for employees is actually functioning at the moment, and Jason is more responsible to his obligations of contract via SDS then keeping Terry happy, which was Higgs problem.

 We are going to keep at shining light on one fact.  THE RESIDENTS OF BAREFOOT BAY DESERVE THE TRUTH, THAT IS WHAT YOU PLEDGED WHEN YOU TOOK THIS POSITION - TO UPHOLD THE PUBLIC TRUST.   

Last week we asked for the legal move that the auditor mentioned had to be taken by the attorney to make the adjustment in the audit "legal."  Of course we were told we couldn't have it.  I presume we had to move that money Cliff did by resolution to cover the Capital expenditures from 2011 that were mistakenly put in the 2010 audit.  

Suddenly in the past three days they have given us all this proof of what they want to prove and at no cost.  Now, that makes me suspicious when we have had to fight for what we get at every turn, and get different answers each day.  So, we got a parade of "answers" but what we really understand is it is all about the question you ask and how you answer it.  We asked months ago for all checks written to the Trustees in the past year or two.  We got one check for $25.oo and a legal disclaimer that there might have been more and if so we may have overlooked them by mistake.  Just doesn't count.  Neither do these answers.  Suddenly after two months, they "give" us answers and before they called the attorney when we wanted them to sign a statement saying that is all the bank accounts they had.  


Good Morning - We are bringing you the findings from the audit and will have the complete audit up for you soon.  

Findings are problems that need to be resolved...BBRD has some that have been ongoing for 2 - 4 years, and some that are new this year...like not reconciling the bank accounts, which hasn't been done for 2-1/2 years!  We  copied the findings in totality.  

Realize that if we were a government entity seeking funding, you must resolve findings or not be eligible.  So findings matter.  

Findings are signs of what is being done that isn't correct.  If you run a red light and don't get ticketed or stopped, some people have a tendency to do it more often because....they got away with it.  The minute they get a ticket they become more "responsible" for their actions versus the law because the law is enforced.  Findings are the "signs" that need attention to get on track.

A healthy Board would welcome input and embrace residents stating "there is something seriously wrong here."  The Board would want to review those facts (findings), meet with the residents and address the concerns.  Not this Board.  This Board harasses, threatens, sics the Tattler on people, and covers up the concerns...they resort to creating a "perception of truth" because it worked before.  In spite of all the smoke screens they were able to pull off with the audit, they findings shine through clearly.

We tried to get the newspapers to cover a story about the concerns, but in Florida these concerns are so common that they don't seem to count.  So, we have one choice, give up or continue to shed light on the facts.  Let's not forget our Treasurer wrote a letter stating that we have all the red flags of corruption...you would think she would have eliminated those red flags, or that they would have demanded SDS eliminate the flags...but it didn't happen.

The legal parameters for getting around the Sunshine Laws are so vast that residents who attempt to hold government accountable are basically told "what's the point?"  Poor management, a little graft, a hidden account, whatever...   Happens every day in Florida.  What have you got that matters?  WE HAVE PEOPLE THAT MATTER.  WE HAVE PEOPLE WHO ARE TRYING TO LIVE EACH DAY ON WHAT MONEY THEY HAVE.  THAT IS WHAT MATTERS.  IT MATTERS THAT THEY VOTED IN TRUSTEES TO PROTECT THEIR MONEY AND OUR INVESTMENTS.  SO BAREFOOT BAY CAN BE AN EXAMPLE THIS ELECTION AND STAND UP FOR WHAT IS RIGHT IN SPITE OF ALL THAT IS WRONG. 

October 13 - We are putting up the audit findings, which give you another honest appraisal of how our finances have been handled.  The first one we did yesterday and is below this one.  We are typing in the complete finding in black italicized, and comments are in Blue.  Please realize that with the findings we have if we were a government seeking funding we would not qualify based on these findings.  FINDINGS ARE SUPPOSED TO BE CORRECTED and some of ours have been ongoing for four years, so we can only wonder why in the past three years why financial issues were not addressed.  We start off with a brand new finding that this team cannot blame on anyone else...so we think.

Finding 10-2 - Budget Process

Finding Type:  Deficiency

Finding - During the current year audit we noted that the Board amended the budget on October 27, 2009.  However, this amendment was not posted to the Distict's budget reporting system.  In addition, the amendment was not properly reflected in the financial statements presented to us for audit.  It appeared that the original budget and all amendments had been properly approved and current year actual expenditures were within budgeted amounts. (Imagine that!  It looked like it was proper but it was not.  I believe this might be the area where they tried to put a big expense in from 2010-2011, the improvements at Building A, and the auditor kicked it out as it from the wrong year.  Then they had to find money (accounts receivables? to offset this expense.  The question remains, why and what money was the 143,000 trying to cover?  We are sick and tired of playing guessing games about money.  Why is the board never explains any of this honestly?  Because they knew things were wrong, as Tom Guinther told me, "This Board is not doing anything good for the residents of Barefoot Bay.  I have to end this contract with SDS."  The attorney talked him out of it.)

Criteria - To ensure proper control over expenditures, the original approved budget and all subsequent amendments should be posted in the budget/accounting system.

Recommendation - We recommend that the District institute procedures to ensure that all budget amendments are propertly reported in the accounting/budget system, as well as properly reflected in the financial statements.

Management Response - The procedure to ensure budget amendments was established prior to the beginning of the current fiscal year.  Subsequently, the budget adjustment for 2010/2011 was completed correctly.  


Current Year Findings: 

Finding 10-01 - Bank Account Reconciliation

Finding Type:  Material Weakness

Finding - During the current year audit we noted that month end bank reconciliations had not been prepared on a timely basis.  (Or at all as we were told by the finance manager) Bank statements were accumulated for several months before they were reconciled to the appropriate general ledger control accounts. (We hazard to guess that Milestone Accounting, who we paid $31,000.00 to just up to September of last year was doing this.  This also explains why the reports we get had over a $100,000.oo of uncategorized expenses--we didn't apply them to the appropriate accounts possibly)  Not reconciling the accounts on a monthly basis means that errors or other problems might not be recognized and resolved on a timely basis.  Also, it is generally easier and less time-consuming to reconciles accounts while transactions are still fresh in mind.  (This one really tells us about this Board, SDS, Higgs, and Finance3.  Come on.  High school kids know this.  The fact is we checked out the resume of the Finance Manager and it seems she is slippery with the facts.  
She claims a two year degree from a college that has never had a Chevallier there.  So tell me....do you think we have enough for SDS to let her go now?  That was their excuse before this.  This Board is keeping her in this position because she knows too much.  As she proudly told me, "Sexual harassment, breaking of the Sunshine laws and "other things."  What's left???   If SDS manages, then they better get on the stick because this is the first law suit based on breach of contract.  I hope Jason Yarborough is truly managing Finance and has not been told that Higgs will manager Chevallier.  That's what got us into this mess.  

When the books are a smoke screen, when suddenly they start providing documentation that is all dated as of September, there is no doubt there are other things.  It is not easy in this state to get clarity.  Did you know that Florida has the fastest rising rate of political corruption?  It seems we have great laws but no enforcement in spite of a lot of talk...that is what two grand juries discovered.)

Criteria:  To ensure proper accounting and reporting, bank reconciliations should be prepared and reviewed on a monthly basis to detect errors or other problems in a timely manner.

Recommendation:  We recommend that all bank accounts be reconciled each month prior to preparation of the monthly financial statements.  Timely is considered to be as soon as reasonably possible after the end of the month and no later than thirty days after the month has ended.  (Bank reconciliation is tedious, and requires two people other than the finance manager to do it for proper cross check to insure honest.  This would be when every bill paid is reviewed to make sure you have the proper invoice, approval and documentation, and then you make sure all receivables reconcile -- which should be easy as long as they are all going into one account.  This is the first place small businesses, let alone large, keep a handle on control against fraud.  Why would our Treasurer not insist on this?  Why has this Board not even mentioned it and instead tries to "sell us" on a perfect audit?  It is not too perfect when you don't do the basic, simple things that assure residents our money is safe.)

Management Response: A procedure has been written that will train a staff member to reconcile the bank statements within 10 days of receipt of statement, reviewed and approved by the Finance Manager, (recommended by independent auditors) and the Community Managers, then copied to the Board of Trustees.  (Finally, after 2-1/2 years, we get a procedure.  We hope it gets done.  We will start asking for the reconciliations to insure it is.)


The finding below has been carried over from past years...

Finding 07-05 - Year End Closing

Finding Type:  Significant Deficiency

Finding- Accounting staff of the District currently does not have the prerequisite knowledge of governmental accounting and reporting to properly preform year-end closing procedures.  The District did engage a qualified third party to perform this procedure.  In addition, the District recently hired a Community Manager, who has been involved with governmental entities for several years. (This was the 2008-2009 audit, and Higgs was supposed to help improve this, as well as educating the staff.  Didn't happen)

Criteria - To ensure that proper year-end closing procedures are performed, District staff should have the appropriate level of understanding of governmental accounting and reporting.

Recommendation - We recommend that the District provide training to staff specific to governmental accounting and reporting.

Current Year Status - The year-end closing process continues to improve resulting in a reduced number of audit adjustments for fiscal year 2010, compared to prior years.  However, during the current year, we still identified an audit adjustment related to capital asset balances.  This adjustment occurred subsequent to District staff providing us with a closed trial balance.  Therefore while we have noted improvement in this area, we do not consider this finding to be fully resolved.

Management Response - In processing capital assets for the fiscal year, staff included items that were not in fiscal year 9/10; were 10/11.  Further oversight by the Finance Manager will resolve this finding. (Accountability -- never happens with the Board and Finance Manager.  She blames staff!!  There are two layers of book keeping that goes on at Barefoot Bay, at least up until September 20th.  One that only the Finance Manager controls...not the staff.  We hired Milestone and we still couldn't get it right?  I guess it was not meant to be right....)

Finding 07-04 - Assessments Receivable

Finding Type:  Deficiency

Finding - During our audit of the District's accounts receivable, it came to our attention that the detail listing of receivables did not reconcile to amounts reported in the District's general ledger. (This was 2008-2009 audit)

Criteria - Amounts reported in the general ledger should agree to the corresponding detail sub-ledger information. (Income in does not balance)

Recommendation - We recommend that the District ensure that sub-ledger information agrees to the general ledger and that periodic reconciliations of of this data be performed on a regular basis.  The District should also consider using the County's resources to perform the billing and collection of assessments as part of the County's tax assessment and collection process.   (This was what they recommended a year ago and they thought the County collecting would solve it it seems?

Current-Year Status - Currently, all District assessments are collected by the Brevard County Tax Collectors.  However, receivables from prior years still need to be evaluated for collectability.  District staff began this evaluation subsequent to the current year end.  Therefore we do not consider this finding to be fully corrected as of September 30, 2010. 

Management Response:  The District continues to collect delinquent assessments that were outstanding prior to annual assesssments being collected by Brevard County, as well as adjustments to sub-ledgers as necessary.

(So we have to pay attention to the receivables that are sitting on our books in spite of having the County collect for us. )



10/12/2011 -  Okay, let's look at the findings on the audit.  Due to the inability of seeing documents on here, I am going to type in the full findings, one a day.  Black italics will be the finding and our comments will be in blue.   Soon we will put the whole audit up.

Findings are "problems" that need attention and should be corrected.  If BBRD got a perfect audit, they would not have any findings, in spite of their rhetoric and ability to sell an audit without any paper such as this Board does.  So much for forthrightness and honesty.  

Prior year findings are ongoing, and some for BBRD are for the past four years, others are new.  Audit will be in Italicized type, comments will be in blue.  

Finding 06-03 - Financial Accounting and Reporting Policies and Procedures  

Finding Type:  Significant Deficiency  (MEANS IMPORTANT AND IF WE WERE TO RECEIVE GOVERNMENT FUNDING THIS TYPE OF DEFICIENCY MIGHT STOP US FROM GETTING IT-as they require they be resolved.  Guess this Board really took it seriously.)

Finding - During our evaluation of the District's policies and procedures, we noted that the Policies and Procedures Manual has not been updated since July 2004 and does not reflect the current operations of the District.  In addition, a procedure has not been put in place to update the manual to include the ongoing policy changes by resolution of the Board.  (this is last audit....who was our attorney then??)

Criteria - To ensure proper accounting and reporting, related policies and procedures should be updated and maintained to reflect current procedures.  ( last year, makes it pretty clear)

Recommendation - We recommend that current financial policies and procedures be formalized in a written document and approved by the Board.  Review of these policies and procedures for accuracy and relevance should be performed on an ongoing basis.  (This is last year's recommendation - which they didn't do anything about because no one was stirring the pot like they are now.  "Just keep those monthly fees down and the residents won't care what we do." is the  past attitude of this Board.  We need to set an example for Florida and make national news, showing the country that when residents are informed they take action for change.  )

Current Year Status - The Board approved various financial policies in the prior fiscal year.  However, as of the current fiscal year end not all financial accounting and reporting procedures have been developed, implemented and submitted to the Board.  Therefore, we do not consider this finding to be fully corrected.  (Meaning it went on before and they did nothing!)

Recommendation - We recommend that current financial policies and procedures be formalized in a written document and approved by the Board.  Review of these policies and procedures for accuracy and relevance should be performed on an ongoing basis.  (Last year!!!! and they didn't do it!)

Current Year Status - The Board approved various financial policies in the prior fiscal year.  However, as of the current fiscal year end not all financial accounting and reporting procedures have been developed, implemented and submitted to the Board.  Therefore, we do not consider this finding to be fully corrected.  

Management Response:  In May 2009, the District Board of Trustees revised the Policy Manual, removing "procedures".  Job instruction training and procedures are established and updated by management on an "as-needed" basis.  Department Managers are responsible for instruction and training on the updated Job Instruction Training and Procedure Manual, per policy of the District Policy Manual.  (This is a load of horse manure!  Financial Policy is in the policy manual and we are rewriting it now, putting in things like reconciling bank accounts so there can be no more excuses.  How can you be financially responsible with someone else's money without doing that!!

This Board laughed at what we are doing with financial policies - but that was before the audit.  I hope they aren't laughing now!!!   Joe Klosky, is responsible for making it a priority, and we have a great committee.  In fact we have managers who come to this meeting when they are on vacation because it is such a productive, well-run meeting - 

Imagine managers, residents, District Manager, Trustee all working together....we haven't heard one screaming accusation from Higgs about "breaking the Sunshine Laws."   EVERY PERSON IS TREATED WITH RESPECT BECAUSE WE ALL COOPERATE TO DO WHAT IS IN THE BEST INTEREST OF THE BAY!!!   We worked with Jason Yarborough and I am happy to say it was a pleasure.  He seems to be empowering managers instead of micro-managing as Higgs/Chevallier did. 

Let's go back to the basics - have you heard the Board acknowledge once that they should have overseen SDS/Higgs/Chevallier and made sure we got RECONCILED BANK ACCOUNTS AT THE VERY LEAST!!!  We haven't.)  

It takes a lot of time to enter all this and we are trying to make sure we are explaining it so it is easy to understand--because when we started looking at these it was strange reading.   

We know you deserve to be informed.  We will try to have another one tomorrow!! Four more to go!!!!  Hopefully this will trigger an investigation by the Auditor General, as there is criteria for not resolving findings for so many years....but then Florida seems to have a lot of laws that just aren't enforced....C'est la vie!

10/9/2011 - Sue here.  Thanks for the blog JR. It makes it quite clear that you are a part of whatever it is that this Board doesn't want to acknowledge.  I have no agenda except to get honest answers for honest questions, which is our right and obligation by law.  And since we started looking up the past finances and what was going on around here - we have had to pull teeth for answers to information that is supposed be public record.

I have been busy but wanted to address Tom's article.  Tom says we are way behind on projects, but he has been there 4 years....WHY ARE WE BEHIND???  We had plenty of money, Tom turned the Bay over to Higgs and Chevallier, who ran everything--the Board allowed it.  So what's the excuse?  Are we supposed give him another two years?  Not me.  I have seen enough to know that what I want is honesty.  I want the bank accounts reconciled, which was supposed to be done three years ago and still wasn't as of three weeks ago.

I want Trustees I can trust.  Trustees that encourage interaction and getting the facts because there should be nothing to hide.  I have no interest in any part of running the Bay, except for making what is wrong right, for the people that have believed that everything was okay.

In the past three months, Guinther talks as if this was his "administration."  It is not.  This is a five member Board that all have equal power and have voted to uphold the public trust.  We are holding them accountable to that pledge, and they don't like it.  They attack me personally - just makes them look guilty.  Then they have the nerve to attack and call out Klosky for malfeasance?  Guess the attorney has an agenda too.

I do not choose to attack Tom Guinther, Louise Crouse, but I have the right to look, to dig, to go on fishing expeditions, to figure, to judge, to attack what they do.  My biggest question was how they could let Terry Chevallier control them and everything else.  Higgs did not run District, nor did SDS.  The Board allowed all that happened.    

Tom says in his recent article in the Press Journal that he "wanted to get on the Board because of the financial mess we were in."  But I have his letter right here, the one he wrote in 2007, and never once did he mention he wanted to get on the Board for that reason.  Where's the truth?

What he does say is, "I think the Barefoot Bay Board of Trustees should consider a change of direction in the management of the district which would include a system that promotes better communication between community managers, trustees and the residents of Barefoot Bay and more trustee involvement in everyday operations to insure a smoother overall operation of the Bay."

Sounds good, but it sure didn't happen and more Trustee involvement is not what a Trustee's job is.  That is the job of SDS and the District Manager.    We have had poor communication from the Board to the residents, as no one knew what was going on!!!  And things certainly aren't smoother.  We talked to a huge number of people that were and are disgusted by the antics and threats of the Board at the last meeting.  They have JR and others in the crowd to mutter sit down, you don't believe her.  Why do you need all these antics? 

Tom could have done a great job as Trustee in the past four years.  I wish he had.  But for reasons that he chooses not to admit, he was unable to do most of the things he wanted to do.  I am sorry he listened to the poor advice of the attorney, because what this community is demanding is honesty, and we still don't see it when 4 out of 5 trustees open their mouth.

As for the finance manager, you bet.  Any finance manager that doesn't reconcile bank accounts needs to go-- I don't care who she has in her pocket.  There is a reason she got away with all she got away with; counting cash, no bank accounts reconciled, treating employees lousy, no correction of audit findings......The answer is in those reasons.  Those reasons are why this Board wants us to stop.    Accountability is hard to see when there are smoke screens of numbers and reports.  

As for Joe Klosky, I just got to know him on the Policies Committee and he is entitled to work with and talk to any residents he chooses, and I would say he has much taste than the other Board members.  Just as these four Board members choose to work with people that support them, we support the honest interactions that we find with Joe.  YOU SEE THIS IS SUPPOSED BE OPEN GOVERNMENT.  JR's/Tom's blog makes you try to think that we want something else or we wouldn't be doing this.  Why would we demand the Board be open about the past finances?  Why would we demand to know why a finance manager that doesn't balance bank accounts but does everything else?

THE ANSWER IS EASY. THE SUNSHINE LAWS GIVE US THE RIGHT TO HOLD OUR GOVERNMENT ACCOUNTABLE. IT DOES NOT GIVE THE BOARD, NOT THE ATTORNEY THE RIGHT OR AUTHORITY TO STOP US OR PUT OUT A CONTRACT ON US.  

 IT SEEMS OBVIOUS THAT FLORIDA DOESN'T ENFORCE THE SUNSHINE LAWS, THEY JUST HAVE THEM IN PLACE.  IT IS UP TO US TO ENSURE THAT OUR COMMUNITY IS BEING RUN THE WAY WE WANT IT RUN.  

WE EXPECT TRUSTEES UPHOLD THE PUBLIC TRUST AND FOLLOW THROUGH WITH WHAT THEY PLEDGE TO DO.  TO DEFEND OUR RIGHTS. TO SPEAK UP AND MAKE SURE THE CONTRACTS BBRD SIGNS ARE ENFORCED, LIKE SDS CONTRACT.

  WE WANT THEM TO DO THEIR JOB!!

This week I had several pleasant email exchanges with the State Attorney's office, which I was pleased to see that although the Four Whining Board members called out a contract on us, it seems the law has come between the Board and us. 

We have the right to ask for what we want, and they have the right to say no -- if it is legal.  The problem arises when they start hiding the "facts" and documentation so when we ask, it won't be there.  This makes it difficult, but the fact they do this just means it takes a little longer and makes them look more worse.  I am not judging their guilt or innocence, I am stating that because of the turn on us--the same people they loved working with--there is something wrong and this Board does not want us to know what it is.  WE HAVE THE RIGHT TO KNOW WHAT THAT IS.

It was mentioned that we are costing the Bay money by asking for what the law says we can have, and that we also pay for.  THE FACT IS THIS IS ALL SUPPOSED TO BE EASY TO GET TO.  If the Finance manager won't allow the clerk to get to information, like most places do, the question is why? And we aren't the ones costing the Bay money.  The fact is things aren't done right the first time.  What costs the Bay money is a Finance manager who  gets paid $52,000 plus a year, has three assistants, and uses an outside accounting firm monthly which cost BBRD an additional $31,000 plus (8 months) on preparation for the 2009-2010 audit alone,  So she is already way over what she budgeted for the entire year, which brings up another issue - We are supposed to know where every penney goes.  We don't.....and WE STILL CAN'T GET OUR BANK BALANCED NOR CAN WE GET REPORTS THAT MAKE SENSE.

What does she do?  Go around answering simple questions that are public record.  Not our problem.  The problem is that the Bay, including us, trusted these people to do what was right and it has not happened

There are times I am tempted to respond to the personal attacks JR likes to join the Board in, but those are not facts.  Those are inflated defensive tactics to try and move the residents away from facts.

I am not a Trustee who is supposed to be holding up the public trust, and the laws of our country for Barefoot Bay.  In fact, when Tom Guinther tried to talk me into running for the Board, I made it clear that I had no interest in that now or ever.  My only interest is in doing what I am doing, what we have the right to do.  Dig for facts and work to make the Bay better, by correcting the things that are not being enforced even though they are in our policies, and our employee manual.  

HERE'S A GOOD ONE.  Did you know that in our policies manual there is NO SMOKING IN ANY FACILITY, AS WELL AS ANYWHERE IN BAREFOOT BAY EXCEPT IN DESIGNATED AREAS.   Imagine, all the Board had to do was enforce the policy that they have looked at for four years.  Instead they blame everyone and anyone.

Advocating for those that don't have a voice is what I tend to do, and it is easy to see why people are afraid to speak up based on how this Board and JR retaliates.

As for Harvey, I can assure you that there are many employees that were dissatisfied with the management under Higgs.   Employees, trustees, residents--there is no law that says they have to hide under a bushel when things are wrong.  In fact, in this country, they have an obligation to speak up.  

Vote for candidates that will bring the word Trust back to Trustee, because as much as I hoped we had a Board that deserved our trust, I can say now that it is not true.  Any Board that attacks and goes after residents, owners, employees that are there for the best interest of the Bay have an agenda that is off kilter and against the law.

Sue here - the resident comment below reminded me of how our legal system works, intimidation and threats, no longer your day in court.  Yes, that is what hte Board did to us in the last Board meeting.  They somehow convinced the auditor to play a game of "make it look nice."  Something this Board does way too often, as they think they can pull the wool over resident's eyes.  

Maybe they can.  This election will tell.  What I do know is we are doing what is in the best interest of the Bay--the others are doing what is in the best interest of covering their behinds.....Look for my Sound Off in the Tattler.  Will they print it?  We shall see.  or do they dance to the beat of the Board....

107/2011 - Sue here.  For the record I want to state that evaluation, facts, discussion, opposing views is healthy for keeping government moving forward as it should.  For some reason this Board believes it is destructive and against the law.  It is our right and duty. 

 We have worked hard with Guinther and Crouse to contribute ideas, expertise, and support for what they do...until we wanted to look into the Finances.  Then it all stopped.  We still appreciate them for what they do well and who they are.  We still enjoy working with them in spite of their defensive attack.  Defensive attack does not over rule the law, although it may intimidate those trying to stay the course.

I was reviewing the minutes from a meeting in 2007 and was shocked to find this said by our current treasurer, Crouse, when we now know the same thing has existed for the past three years without correction.  This does not make Crouse someone to be disliked or not respected, but it certainly gives us the right to state that she is not doing her job--to uphold the public trust she pledged.  

In 2007 and I quote,"Ms. Crouse commneted the bank reconciliation should be done on a monthly basis."  Four years later and this Board has not insisted that management do the basic financial checks that are obvious.  Crouse did not do what she pledged.  

In 2007 Crouse states, and I quote, "Ms. Crouse suggested annually review (of) the manual (policies and procedures) and adopt changes."  Four years later and this is still not done annually.  Crouse did not do what she pledged.

In 2007 Crouse states, and I quote, "Ms. Crouse said currently the Board receives a listing of checks over $10,000.  She wants a listing of all payments made with the Department, the account being charged, to whom the check is made and amount.  She said without that the Board has not oversight."  Sometime in the past year or so the Board has started writing big checks out of the money market, which was originally used as a reserve...we do not find that these are ever documented on the list of checks over $10,000.  nor are expenses charged off to departments.  We had over $100,000 of uncategorized expenses....Crouse did not do what she pledged.



She may have good reason not to, it is our job to discover that good reason and once again, the law gives us that right and obligation.  

We do not attack Louise or Tom, we attack what they are saying that does not hold up to what they are doing.  We will continue to do that in spite of a whining, intimidating, pre-planned orchestration to try to stop us.  In fact, our attorney Cliff Repperger seemed to know ahead of time that this frontal attack at the last Board meeting was set up and planned, as he told us to ask for the information we wanted at the next Board meeting...Why else would he do that?  Also, we have seen emails previous to the Board meeting discussing wanting to stop us, so it was not an off the cuff remark by Mershon. 

I will be back later for my "Blast Off" column on Guinther's article.  I just wish he had followed his heart instead of the poor advice of the attorney.

In the article on TC Palm,com, Louise Crouse states, "...She watches the bank accounts and keeps a close eye on expenditures and she said the district's finances are sound.  Everything I see in the finance department are sound practices, and the district's finances are well handled" ...

If she believes that, residents have a very good reason to not vote for Louise Crouse.  If she thinks what's going on is good finances, she must not know what good finances are.  

It would appear that Crouse's responsibilities as Treasurer would ensure sound practices, but that is not the case.  Louise tries to convince us that all is well, when the Finance Manager...
---Has not reconciled the monthly bank accounts in 2-1/2 years!!!
---Neglected to balance the ledger
---Is unwilling to verify in writing all the existing/existed bank accounts for BBRD this past year alone
---Tells us the trustees all have access to the bank accounts (which they should) when, in fact, they do not
----Employs two full-time assistants as well as contracting with an accounting firm for $31,000 to assist her in doing monthly financials and end-of-year audit prep  
----Did not post the amended budget from October 27, 2009 nor reflect it in the financial statements, as per one of the five findings in the 2009-2010 Audit 
----Did not prepare a correct trial balance causing the auditor to do an adjustment after the trial balance was submitted
----Neglected to apply capital assets to the 2009 - 2010 financials, so the Trustees had to pass a resolution at the last meeting to amend that budget
----Applied 2010-2011 Capital expenses to the 2009-2010 books--What's that about??
----Used to give us lousy financial reports and now we get none (not even on the BBRD website!!)

Is Treasurer Crouse selling us a story that these are good financial practices?  Maybe she can sell that story to Steve Smith at TC Palm.com, but not to informed and caring residents who love the Bay!!

It's another perfect morning in Barefoot Bay!

Just a reminder that we have asked the Supervisor of Elections to come to our area which will make registration easier for our residents. They will be at our S. Mainland Library (behind the fire station)  THIS MONDAY,  October 3rd from noon to 2.  

If you are a registered voter and would like an absentee ballot mailed they can do that. If you prefer, you may just call  321 633-2124 and the ballot will be sent.

This is Sue--For the record I want to state that yes, I did interrupt at the last Board meeting.  It is true and it is a fact.  

We have spent hours tracking and working to bring to the surface, things that seemed to be well hidden and not properly handled--especially in the Finance Manager's area under Higgs.  It is our right as residents and citizens.  This is supposed to be a transparent government and yet we have to dig to get simple facts and documents.  So that night I was tired and reacted.  If that offended anyone, well I am sorry it did.  I have seen Tom Guinther lose it with the Finance Manager.  It happens to the best of us.  But I will promise residents it won't happen again.  

Any bank account numbers and documents that we have are all covered under the Sunshine Laws and came right from our own Barefoot Bay office--not from any bank.   We have never posted them on the internet, which is self evident.  

As for "validation" of news, referring to an article in the Vero Beach Press as stated on the Tattler Blog-- well, it depends on your definition of news.  Our definition would be if that author had ever called and asked us one question ever, about any of this, which hasn't happened.  

As for JR and The Tattler, JR has gone from railroading me out of town, to us being a terrorist group, to me being an intelligent person, to the latest--he seems to swing with the beat of the Board and not objectivity.  That is okay.  It works for him and the Board.  He called me once to complain about the lights at the parking lot, but never to ask about any of this.  

I am not angry at anyone, although I was angry during that Board meeting.  I know each of us does the best we can in the moment, and it is up to each of us to decide if we want to improve and change our future for the better.  

It seems that this is a losing battle and we should just quit.  What's the point?  If residents don't care about what's going on in the Bay with employees, management and finances....Why should we?  That is question.

Good Morning everyone;

   It was a long night last night at the Board of Trustees meeting, from7:05 until about 10:30.   Lots of subjects to cover. 

   First and for most the Good news is that at last Jason Lail from the new

WELLNESS CENTER has been able to sign his least for 5 years. The work to make the area ready will begin in the near future after the board has the bids sent out and a contractor is hired.

   The convenience store right next door was approved for a new 10 year lease. A win-win for us all.

   The audit is not yet complete but Mr. Blend came and gave a report.

He feels we are improving but there are 2 material weaknesses (1 of which includes three points) reported, but realize that no one has seen this in writing that we know of. 

   We still have 3 findings (things that are not right) that have not been corrected.  One was from 2006, carried into 2007, 2008, 2009 and now 2010. The second finding was from 2007, and carried forward to 2008, 2009 and now 2010. The Third is the same situation, something that needed correcting in 2007, and continues to not be corrected through 2008, 2009 and now 2010. We also have the yearend closing that has not been resolved (the books don't balance).

   It is expected that the formal complete audit will be sent to the board in a few days. The details should all be in it. You are entitled to a copy of this audit and can request it at Building F. from Sue Cuddie (they may charge you) or you can go to http://www.myflorida.com/audgen/pages/specialdistricts_efile%20pages/barefoot%20bay%20recreation%20district.htm and it should be up here on the Auditor’s General website by October 1.

   A person for the opening on the violations committee was chosen. There were 3 candidates.  I am sorry I did not write the gentlemen's name down but he has many years of law enforcement in his background and has a wonderful attitude.  He wanted to get on the committee to start improving the appearance of Barefoot Bay, and we welcome him to that committee.

   Trustee Mershon was upset that residents of the Bay were asking him about the financial status of the Bay.  (Which may in part be due to the fact that Bill Blend said the monthly accounts had not been balanced.)  This certainly makes it difficult to “account” for “errors” when you can blame it on something as simple and basic as monthly reconciliations.  Many of as individuals balance our check books each month, that's how we keep track.  It is a sound practice but our finance department has not done this.

   After discussion with many residents over the financial situation in the Bay, Sue and I have been seeking the answers to this dilema.  We have spent months doing research, getting the facts on “what’s what”.  It has not been an easy task.  Some resent this (although I am still not sure why) We are ALL entitled to see EVERYTHING, we are an open free government and Florida says we are entitled to see any records about our financial status.

   We have questions now about a few other accounts/transactions.  Once seen, we feel we will have completed this research.  Although we hope to find nothing of concern, the difficulty and resistance that we encounter sends up a red flag.  Because some of these records have not been available to us we wait,,, we have made requests but the answers are “what we want doesn't exist”....we have documents that show something does.

   So, back to trustee Mershon, he wanted us stopped.  The Board voted to give our attorney permission to do whatever he felt necessary to accomplish this goal.  Now what’s that all about.... Wouldn't you think he would want the answers also.... (not to mention we, the residents, have to pay the attorney to try and stop our research, research is legal.)  Did Mr Mershon come to us with his concerns and ask us what our goal was? No... 

AGAIN, let me remind you that as residents we are entitled to see all records....

   Okay, I finally had my turn to speak. I was shakie and very upset that this entire situation was turning hostile.... WHY was that???

 After the vote to have the lawyer seek out the Attorney General or do whatever is necessary to stop us, I was in a position to now tell the board that WE had already contacted the Attorney General regarding this matter. 

   Last night we requested these records in writing.  Now we wait. Within a few days we hope to have a response. 

   This is OUR money, we want to be sure it is all in order....

   To me it's like putting my money in the bank and the bank being offended if I want a statement....

   It makes a person wonder?

   Some residents may feel this is not an important issue.  But others do. 

   Well the evening wasn't over yet.

   Now the issues of the no smoking areas at pool 1. People spoke. Trustee Klosky asked if the newly appointed smoking area could be moved to accommodate everyone. Trustee Crouse was not for this change. However Trustees McAfee and Mershon intervened and a vote was taken to make the designated smoking area to the south side of the lounge, under the roofed area. This will be final and enforced. Everyone seemed happy with this arrangement. A win-win except for the question of how it will be enforced.

   We got to meet our new District Manager, Jason Yarborough. He was welcomed and spoke.  He was not dissuaded by the “people being engaged in their government” (his words).  He seemed to be pleased we had “spirited residents” and appreciated the interaction. He signs the papers today and will be in his office at Building F before the end of the week. WE wish him well.

   The Veterans Counsel has offered to provide their service in overseeing the raising and lowering of our flags appropriately and monitor their

condition. There was discussion about this and Bob Kahl spoke to the correctness of this service. The Board accepted. Thank you Veterans for ALL you have done and all you continue to do.

September 26, Monday 2011   IMPORTANT BOARD MEETING TOMORROW NIGHT 7PM BLDG D&E  Audit, New Manager, Smoking and More!  

A busy day today, so I'll be brief.

 

Polish American Club is looking for new members.  Five dollars a year gets you a membership and they meet the 1st Tuesday of every month for a meeting, dinner and dance.  The dinner and dance night cost from 8$ - 12$ dollars.  They also participate in the ethnic festival, which had a great turn out.  Call Joe Klosky if you are interested in more information:  663-2243

 

   I urge you all to attend the Board of Trustees meeting tomorrow night (Tuesday Sept. 27th) at building D/E. 7 P.M. The topics will all be of great interest to us;

   Having the prospective NEW MANAGER being presented to the board for approval.

   The smoking issue at pool 1.

   The HOPEFUL signing of the lease for the new WELLNESS CENTER that wants to come into the bay.

    And most importantly to us all; The results of our AUDIT.

We understand from the Chairman Tom Guinther at the last meeting that he had seen the “binder” for this report and it look good. I am eager for it to be so.....but frankly I have my doubts...SERIOUS DOUBTS.....we are sure there will be unaccounted funds....just as there were last year.  The Finance Manager has not bothered to reconcile the bank accounts in over two years and is just training someone because the auditor told her she must.  Great job Board for keeping her on!!

   WE have been carrying for 2 and sometime 3 years the SAME FINDINGS (things that are not properly done or missing)... normal procedure is when the auditor give a “finding” the problem is stated  and what has to be done to fix it...it seems that we have not been able to fix ( the SAME problems) from year to year,they remain. This is not acceptable....

Perhaps this time all the findings will be resolved. That would truly be good news for the Bay.

   To have the Books balance this year would be wonderful. That hasn't happened either....

    I remain hopeful that at last, things will be done correctly and we truly have an excellent report.

   As a P.S. - I will say we have many people  on staff assisting the finance manager to do this job. Special training has been given so that things will go smoothly.

We also pay a great deal of money annually to have an outside Accounting firm to come in to assist the Finance manager. This audit SHOULD be perfect this year.  Fingers Crossed...

Susanne

   Good Sunday Morning to you all. September 25, 2011

   Today we bid adieu' to our long-time resident, (34 years I think) and friend SUSANNE MARGESON. So many of us know her by “Susanne” the pool host (mostly at pool #3)... she has been a staple of our lives throughout these years.

   She began Barefoot Bay’s water exercise classes many years ago. They continue on today in all 3 pools. Being a lap swimmer Susanne could always be seen at pool one from 9 to 10, even on the coldest winter morning she was there.... with a smile and a hello to all.

   She taught many a child and adult to swim and never charged a penny.

Her “pool side manner” with beginners is something to see, gentle, joking and simple.... I was privileged to be in her adult swim class this summer (part of our SUMMER FUN PROGRAM for adults and children)... Sue and I went to “perfect” our strokes ( I use the term loosely)..... there was a lady in the class who wanted to learn to swim...before the end of that first class, Mary was swimming the length of the pool with us... secure and confident in Susanne’s capable hands. It was always a fun time and we all learned something new each time we attended....

   Another Mary has just moved to the Bay and Susanne has her swimming...

This is a skill she has been giving and giving to young and old alike.... I have no doubt that not only has she shared the joy of the water and being safe but has saved lives by sharing this gift.

   Susanne is packing now and will move next week to Vero Beach. Her friends and co-workers gave a fun party for her last night at pool #1.

Lots of hugs, gifts, food, and fun stories were shared....

   Dare I say she has invited us all to come and visit (but perhaps not all at once)!

   Good Luck Susanne. May health and Happiness always be with you.

Part of you will remain with us in Barefoot Bay.... come back often to see us.

    Hello everyone.  We went to the strategic planning meeting which I will tell you about but first let me back up to the facilities meeting yesterday morning.

   In attendance  at the facilities meeting were Chairman John McAfee, Wilma Weglein, Louise Crouse , Bob Kahl, Tom Guinther, Sue Cuddie, and myself--it seems the other committee members were not informed...go figure.  

  It was a laid back hour and a half meeting during which time a variety of subjects were discussed. The lounge renovations were brought up and the conversation included the time frames where this could happen.

   Ms. Weglein brought up the canopy for building A. as some sort of protection is needed to protect the residents going out of and into building A and C during inclement weather. This may be a project for the HOA. Ms Weglein will be getting prices for this amenity.

   Gutter repairs at building C and repairs to outdoor grill roof at the lounge area are on the list to be done.

     Okay; Now to today’s meeting of Chairman Tom Guinther Strategic Planning Workshop. Present were Louise Crouse, Joe Klosky, John McAfee, Wilma Weglein, Sonny Raponi, Mary Wheeler, Bob Kahl, Nancy Eisle, Billy from the Lounge, Kathy Mendes, Carol from customer service and the Lounge, Jeanne Osbourne, Tony Pitrulle, Carol Joseph, Arlene McGuire, Mr. Bleau, and some others that we don't know the names.  

Isn't this a violation of the Sunshine Laws???  Four Board members....  Oh, but we have three going to committee meetings, so what's the difference?  

This is a Town Hall forum and all in attendance were encouraged to give their input. First on the agenda was The lounge renovations....the plans were finished early June and will be presented to the Board of Trustees at this coming Tuesday evenings meeting September 27th (7 P.M. Building D/E) for approval. If all goes well Chair Guinther feels the RFP's can go out this week and the process may begin. He estimates that it may take until about Nov. 15th to complete the bid process, RFP's,

County and Ppermits etc...that would mean renovation could begin about that Nov. 15th date. If all goes well it should take about 6 weeks. However we are all aware that there are often glitches in construction etc...and the time could be extended. This is a project that residents spoke up about. It has been on the “drawing board” for 10 to 15 years already....and they are tired of waiting.... as “Billy” says, lets “get e'r done”.... and agreement on that was reached.  POSSIBLE completion for first week in January.  Fingers crossed.

      RFP'S will also go out this week to complete the remodeling of the old Laundromat space. If the attorney has the lease properly worded our prospective new tenant the eagerly awaited WELLNESS CENTER will be able to sign it this Tuesday evening at the B O T meeting. I think this will be the fourth month the prospective lessee has come to sign the lease...

  The handicapped ramp at the pool 1.  near the covered area  (south side)is on the list for repair. A handicapped “lift” of some sort will be looked into by the Facilities committee next month. It was suggested by Jean Osborne this may first be installed at pool #3 as that is where the morning exercise class is held for those with arthritis.

  The 19th hole is open but will have an official opening next Saturday, come to the OPEN HOUSE and see the new look...

   The new chairs have arrived for building D/E and they are VERY welcome.

        Lighting for the parking lot D/E was discussed with possibly integrating solar lights.

    Ms. Weglein brought up better lighting of the pavers at building A&C.

   Chairman Guinther suggested a yard sale bulletin board that could be at a “drive up”, central location.

   Trustee Crouse talked about putting a surface down for the walking trail at the lake (building A). Product to do this would be about $8,000.00 plus labor. She also suggested a Shade Sail for the playground area.

   I added that the slide for the children is metal and VERY HOT. Perhaps it could be changed to a safer material. It has also been requested by residents that the mulch used in the playground area be changed to the ground up tire material that is safer for the children. The wooden mulch pieces can be sharp, as well as get stuck in their shoes. It was suggested that the county may be able to help with this.

   Mr. Bleau had several good ideas about the situation with the wastewater from the treatment plant and irrigation of the median, which is owned by the county. Many topics were discussed.

      All in all it was a very well organized meeting and residents were encouraged to bring their ideas forward.

   Next meeting of this Strategic Planning Workshop is set for October 29th. A Saturday at 9 a.m. But check closer to the time for confirmation.

John McCool from the Undergroundf

Albert Einstein once said that insanity was doing the same thing over and over again and expecting different results. Well under that definition it looks like BBRD is insane. Didn't we just go through the resignation of our District Manager over poor supervision and disharmony in the workplace? And now who does SDS send to the Board to be the next District Manager? You guessed it, someone who just resigned over poor management and disharmony in the workplace. I believe I once said that the sitcom "Parks and Recreation" was based on BBRD. Now, I am sure of it. It is even funnier when the candidate in question comes from Palm Bay where George Hunt, another BBRD District Manager loser, was involved in this jokers resignation.

Why do we pay SDS so much money to find us loser after loser to be the District Manager? And for those who think Ms. Higgs was the best Manager BBRD has ever had (and sadly that statement may be true), why did she resign so suddenly when all this stuff about her good friend, who is the Finance Manger, came out? Could there be more that has not seen the Sunshine yet? And while we are speculating as to why people act as they do, how is that the Finance Manger survives controversy after controversy? Why would the Chair of the BOT come to her defense after criticizing her for her conduct at a meeting of the BOT? It is like a spiders web and the Finance Manager is the black widow. 

It is sad to see that the good people of Barefoot Bay have to pay for all this tomfoolery. And they do pay with a District tax that is at least 33% higher than it needs to be.And that brings us to our lawyer. A man who is paid three times his worth, not because of him but because of all of the stuff like the above. When is he going to step up and quit protecting certain Trustees and staff and start looking out for the taxpayers of BBRD?

9/23/2011  We hear Jason Yarborough has been selected as the next District Manager by SDS Inc. We presume they will be voting him in, without it being posted on the agenda in advance, at the Board Meeting, Tuesday night at 7PM, Building D&E  

Jason seems to have a good background but one of the concerns is that he is the manager that resigned from Palm Bay Utilities the day before a report was going to be released about employee treatment.    Strangely enough, the report is now unavailable on the web from Florida Today, whose law firm just happens to be Gray Robinson.  Hmmm.

We will give Jason the benefit of the doubt, and are sure that some of the Trustees will address the situation, well at least one of the Trustees.

Here is part of the report that states the treatment that resulted in the union calling in an H.R. person to do an investigation....it sounds very familiar to the complaints we had when Higgs and Chevallier were running the Bay.  We still believe the intent is to bring Higgs back, and all the indicators, especially the quick resignation of the last great, potential manager, David Kershaw.    

Our problem, as usual, is why this isn't brought out in the open.  If it was brought out instead of hidden, we might be less suspect, but as usual, that is not the way business is done here.

The allegations identified through the investigation included:

·  Employees feared they would face retribution if they brought up safety concerns.

·  A maintenance worker threatened physical harm to managers and other employees.

·  Managers treating employees "as consumable resources to be easily replaced."

·  Employees being disciplined for "poorly reasoned situations and process."

·  Managers borrowed city equipment to use at home. The report did not detail what type of equipment was used.

Okay, it's going to be another busy day...Facilities meeting at 9:30 this morning. It has been a long time since we have had one.

   I did get to speak with SDS's Jason Pierman yesterday, he was “on the road” as he has a lot of properties to oversee. We touched on a few subjects but the ones you most want to know about are the audit; results of which will be delivered to us all at The Board of Trustees meeting Tues evening sept.27th, 7 p.m. At building D&E. We continue to have issues which will be discussed at the meeting.  (those are my words, not Jason’s) Please attend. We will give you a full report after that meeting.

   The smoking situation at pool one is still an issue. Since the board passed the new designation areas for smokers it has not been possible for the pool hosts to enforce them. It seems smokers wish to smoke in other areas.(the old areas where smoking was permitted). It is for the board to decide how they want to enforce this new regulation.

   Last week I heard that police might be called in. I was not sure how that could be. However that can happen IF a person does not follow the rules/ regulation set by the board...and is in violation of these rules and is told about the rules and still will not comply then the resident will lose pool privileges. Once they lose those, they are NOT allowed to be at the pool and therefor will be trespassing...then the police can be called....and the resident will be removed. That is how the law works.... so now we are informed.

    I have heard from a few sources that today a prospective new manager will meet with our Board of Trustees. He is reported to have excellent  recommendations.   If the board is pleased he will be presented to us at the Tuesday  evening B>O>T> meeting. Fingers Crossed.

   Good Morning;

   As predicted Chairman Klosky's Policies and Procedures committee meeting yesterday ran like clockwork. The nine people work extremely well together in an atmosphere of business and comraderie.  Two hours of  intense working got the job done...Items like procedure for dealing with formal sealed bids, RFP'S, temporary employees, use of district facilities, clubs, temporary lounge passes, Bank Accounts, payroll procedures, annual debt payment and more were given intricate inspection and in some cases revision so that they are clear and concise.

   It's always a well outlined forum and if chairman Klosky has more that 2 cups of coffee we will NEVER be able to keep up with his fast paced meetings. Go JOE!

   I am sorry to say that as yet I have not received a reply from SDS Jason Pierman (and it is my understanding that others who had tried to reach him have not also).  I will try again today to get answers to your questions.

   During the new HR person meeting employees were told that her role was to move the information along to SDS, but what happens then??  Nothing it seems.  So the contradictory situation remains unresolved.

   Our finance person Terry still gets involved in positions that are not her area even though SDS president Pete Pimental told us all at a Board of Trustees meeting that she would stay in Finance. 

   All of these issues with our SDS management are disturbing. I see us not moving forward with a TEAM.. but the same old style of US and THEM. Which is NOT what we hired SDS for, nor what the Board said they wanted.   SDS promises have not been kept.  WHY?  Maybe they are not in charge?

   We all had high hopes that SDS would keep their word and get us on the right foot...to my eyes....NOTHING has changed... we still have a broken chain of command.  We have someone to listen but with no authority to make the needed changes.  Jason came in strong and now seems to be fading into some other role.

     It's almost October..... We are still waiting.

    Good News for all the pool goers: the new lounge chairs have started to arrive, 14 are now at pool 1.  I'm not sure about pools 2 & 3 yet... They are just the ones requested....tall and nice. There is a lot of area to fill so we hope they keep coming.

   As for pool 1 and the smoking issues, I am told that the new smoking regulations will be pointed out to residents but not enforced until after the elections November 8th. Whats up with that???? Hummmmm

     I have a phone call into SDS's Jason Pierman to confirm this and also to ask a couple of other questions that you have been asking us...

   More information listed is the fact that the gaming business “starlight Palace” in Debastian has been asked to provide free transportation for our residents. Although this may have been asked for it is my understanding that the board of Trustees should be notified and a request made for permission to have the private van come into the bay and provide this service. Perhaps this request is already on the docket for the next B O T  meeting Dept.27th??? Services to residents are always appreciated but BBRD sponsoring gambling pickups??.

   The Home owners association is now looking for officers and directors. If interested please call the nomination Committee Chairman Joe Klosky at 663-2243. You must be a home owner and be able to meet 2 evenings per month.
